Mmm… Not really sure which way that blows, tbh. Unless I`m missing something here (and I probably am), I think it would have been in their best interests to first establish a real link between the guy and the blue mercedes he was said to have been driving, then take it from there. Was he being stitched or was it a bit of astute policing?

The officers kept calling them by name so I’m assuming they’re regular protestors at the site. The police officers reaction was OTT and nowhere did he say he’d had anything to drink other than tea.
However - If he hadn’t had anything to drink as he claims, why not just do a breath test so they can all go their separate ways. By refusing a breath test (even by principal) it carries the same penalty as a DD conviction.

m1cks : Yeah, It was a bit churlish of him to refuse the breath test, but I suppose in the heat of the situation his righteous indignation kicked into overdrive! At least common sense and correct judgement finally prevailed. Itll be interesting to monitor the progress of his lawsuit. probably will be settled quietly out of court. (with taxpayers money, of course)
