Truck show , drivers hours

might have been covered before , but mate has done his weekly driving , sunday till early hrs friday morning . needs to take his unit to show on friday night & drive it back to yard on the sunday then start shift monday afternoon , so he is breaking into his weekly rest period . he says that he can drive it cause its not for hire or reward , but must use his digi card , so he is gonna take a print out and mark it that he was taking unit to show … ■■? , i dont think thats gonna be legal in mr.vosas eyes , whats your opinions .

I think that the ‘private use’ malarkey only applies to 7.5 tonnes or less now.

Also, is he being paid/made to attend the show by his boss? If so, it’s ‘other work’ in the letter of the law.

I’ve often thought that, if VOSA chose to, they could stop weekend truck shows by rigidly enforcing the law. But they won’t because, apart from anything else, they actually attend them to reach members of the driving community.

If over 7.5 tonnes GVW then no exemption applies so it will legally have to be recorded as driving/other work etc

I’m still re-learning the regs and catching up after 10 years away but from what I can gather your mate will have to use the weekend as a reduced weekly rest period and ensure he has not driven more than 56 hours in that week (or 90 in the past two) to give him enough driving time to complete the drive to and from the shows.

He will have to remember to make up for this reduced rest as well.

Admittedly I’m out of touch a bit so a call to VOSA to double check might be worth while.

Depends which Vosa officer pulls him up I suppose. An owner driver from my neck of the woods got stopped for a routine vehicle check and they commented on his nice shiny alloys. He says yeah took me all weekend to get them up like that. Asked to see his tachos, no record of the ‘other work’ spent cleaning his alloys so give him £200 fixed penalty for insufficient rest and failure to keep records!

I have read a bit on this lately, and if he can prove the all up weight of the unit is under 7.5 T and he is not pulling a trailer I reckon its legal provided he is not being paid in any way shape or form or doing any other work when there…and I think they will say cleaning it is work so beware.
Why not ask them ?

After doing 55-60 hours in a week (paid for only 55) I can’t be arsed to go on the Saturday truck washing rota, never mind showing the ■■■■ thing.

Heard stories like this on more than a few occasions are we really supposed to believe it

Its the plated weight not the actual weight, as all units are plated over 7.5 tonne you have to use a tacho and all driving regs. No disrepect but are people that thick to not realise there are NO exemptions when travelling to or trom a show it will impact on your weekly drive and possibly weekly rest :smiling_imp: :smiling_imp: :unamused: :unamused:

Whatever about whatever, does he really want a dirty card for the next year or so that smudge will stay on the record? He would need to keep the printout in his pocket for at least six months I’d say with a pre rehearsed excuse & proof.

I don’t know if its legal about the not for hire and reward get out clause.
