Doing some agency work and I am wondering, does travelling to and from work count towards the WTD or is it classed as outside working hours? Distance from home is 30mins each way.
Travelling to and from work does not count as working time either for the drivers regulations or the WTD.
The only time travelling to and from work is classed as working time is when a driver is travelling to take charge of a vehicle, or returning from a vehicle, that’s not at the drivers home or usual operating base, under normal circumstances that doesn’t really apply to agency drivers.
I assumed that as agency the normal base bit to mean the menai depot of the client you’re working for and that of you’re off to pick up one of their trucks from say a service station then that would be non - standard the same as for an FTE.
I wonder for how long this will remain true.

It is difficult to see how it can be logically argued that professional driver travel to/from work isn’t work, but for care workers, sales reps etc it is.

Travelling to and from work isn’t counted as work for care workers if they start and finish at their base or office, the travelling to and from work is only counted as working time if they travel from home to their first appointment which isn’t at their base or from their last appointment to go home rather than their base.
Just the same a lorry drivers now.

Because this ruling is for the 1998 wtd covering everyone except mobile worker,
we work under the road transport wtd 2005 for mobile workers which is a completely different regulation.
