He is 54 and passed class 2 many years ago, he’s bought an old 17ton Iveco with a grab on it and is using a log book as always only near home on restricted O licence . Can he legally now tow the digger on said trailer with the Iveco? Or should he have a class 1 ? He’s unsure and honestly I don’t know…

Depends when he passed his class 2. could have C+E with 102 restrictions (drawbar trailers only)

Does need to use a tachograph and comply with EU drivers hours rules though as it’s a 17.5t vehicle.
The EU exemption which I believe he thinks he’s entitled to use states:

"Vehicles or combinations of vehicles with a maximum permissible mass not exceeding 7.5 tonnes that are used for carrying materials, equipment or machinery for the driver’s use in the course of their work and which are used only within a 100 km radius from the base of the undertaking and on the condition that driving the vehicle does not constitute the driver’s main activity.
This would apply to tradesmen such as electricians or builders carrying tools or materials for their own use."
It’s not 7.5t or less, needs a tacho.
The only other exemption he may think he’s entitled to use is “Vehicles used in connection with sewerage, flood protection, water, gas and electricity maintenance services, road maintenance or control, door-to-door household refuse collection or disposal, telegraph or telephone services, radio or television broadcasting and the detection of radio or television transmitters or receivers.”
But this only applies to new constructions, such as new roads or water/gas mains being laid, not working repairing existing ones and does not apply to commercial waste collection.

He works on sewerage, and has been pulled , DVSA quite happy about restricted licence , but he wasn’t towing at the time.

That’s my opinion too Rog …
Forget the Iveco.
What you need is an ex utilities van, smash one of the roof beacons so it just revolves a blinding light. Then, get a knackered trailer and remove all the bulbs but one indicator and ditch the number plate. Make sure you leave one strap/chain loose and make sure you have a few feet of it hanging over the back of the trailer, however you should employ good H&S by hanging a twenty year old hi viz vest on the furthest point.
Remember to never drop below 70 on the motorway, don’t forget, the only exemption you need is the one to use lane 3, that seems to be the norm for pulling plant these days

My son works for the local Highways department joint venture and they all run log books on their HGV’s repairing and maintaining county roads.
Other way around getting the mini to site is to pick it up and load it with the crane with a set of slings or chains. Securing it is the tricky part but it could be an option.
