Deathstar:
Quite simply your face doesn’t fit and you are being taken for a mug.You made your mistake the first time that they asked you to do something above and beyond the call of duty. It’s probably too late to do anything about it now and for your own piece of mind you would be better off looking for a new job…
quite agree here. you made your bed and now you have to lie on it. crap as it is sounds like you the company have a like it or lump attitude with you.
I’m quite [zb] off today. I had a meeting today with my supervisor and his assistant (ridiculous). Basically I complained about hours. I get £300 a week (£262net) and do as many hours as they want me to do. What annoys me is older drivers who do exactly the same job but don’t exceed 8, 9h a day. So I work 11, 12, sometimes 14 hours a day and to be honest I’d do that without second thoughts if I knew others do the same. They wanted to scare me, the so called assistant had a piece of papper and supposedly was recording the meeting. In fact he was doing it for 5 minutes at the same beginnig then he stopped. They called it an informal complaint. If I’m a young driver does it mean that I have to work harder for the same money?
3 weeks ago I had to complain about weekly rests becouse I hadn’t had any. Unfortunately the company didn’t know it and they didn’t take proper weekly rests for a few years, ridiculous. I told the supervisor about it but maybe I should of called VOSA.
What can I do about it? take a leagal action or just quit?
Cheers,
Rob
Are you British, or from another Country, if not British then they could be taking advantage of the fact… And you ‘could’ have a case against them.
dont always believe what your being told about hours, theres some real wind up merchants out there, normally the older ones, what there telling you, and what there actually doing are probally two totally different things

You are commiting the offences, ok your boss is as well by allowing it to happen, but i don’t think it would be a clever move to grass yourself up to VOSA, espec if your doing a lot more hours than the other drivers, espec if they come along and your the only person running bent and the employers make up some crap about didnt know you were doing it and will try harder for it not to happen again, and your bitter employee etc…
Amazes me when drivers dont take proper weekly breaks then say well its not my fault my boss asked me to come in, espec when its huge companies and the person giving out the shifts prob doesent have a clue what shifts you’ve worked. They allways seem to think it will be the boss that gets into trouble not them.

The only wrong in that Story is You
Put your Tachograph always to the right Mode. Working and Driving is working. Break is Break, and when you get said you have to wait for,we say 20 minute, then switch to POA.When you start doing anything switch back to working, and finish after 48 Hour Working Time. Thats Working and Driving counted together.Break and POA doesn’t count to that. But,you mustn’t switch to POA if it isn’t known,or expected by Experiance in advance in Time, about.
If they make doing up to 60 Hour/Week then do it and go after 17 Week for each Hour you did over the 48 Hour one Hour off.(Holiday, unpaid)
If you must do longer than go up to 26 Weeks, but that you can only do if a writen Agreement between You and the Company exist.
If anyone complains say that you as Young Driver need Time to learn the tricks doing Ilegal
This and many other recent posts illustrate that, them that do, do! and them that don’t! either teach, or run traffic offices!
Posts like the WTD where clearly the agency or the operator hasn’t a clue about the rules, other posts like the digital cards and an agency requiring a printout every time you break wind. It is a worrying fact and one that probably needs VOSA or Ms. Bell to look at the problem.
The laws are not in place to remove an incompetent or inept traffic clerk, but they are there to close a well established company down because of his or her actions.
When you are just new in a job you always have to make sure you let them know how you stand about certain things.
On my first week on the tramping and dealing with a new set of traffic planners I had to do this. They knew I was green in the job and they were trying to use that to their advantage. One day I had a right old time of it with traffic delays and all that jazz. I’m based in Scotland and it was my first time running around London aka the big smoke. I was on my way to the last drop of the day and I knew I was running late. Being a good boy I called in and informed them if the delay and gave them an ETA for the last drop. I managed to give this ETA by setting my TomTom satnav to a max speed for 54mph and added an extra half hour to the total time for good measure. Okay no problem they said. As my luck would have it I got caught up in yet more traffic and as a result I was now in need of a 45. I called up the office and they indirectly ‘suggested’ I just run on as I’m in traffic anyway. I instantly blew up at them down the phone shouting lots of naughty words like VOSA to which they instantly backed down. That way they knew I could not be leaned on to go that bit too far. If that were someone else in that situation, whom perhaps wasn’t as clued up on the hours as I am, I wouldn’t be suprised if they just ran on all because the planner asked him to. Then after that one time that’s them they will think they can do that to you whenever they want.
Long story short NEVER let anyone walk over you or try and get you to bend the rules. Now I get a lot of respect from the TM, planners and office staff and usually if I ask for a day off etc then I’ll get it.

That’s a good story. And this is your personality and I’m not quite sure if I could react this way. But that’s the only way you can achieve something otherwise people end up like me. I need to start looking for a new job and it seems to me, the problem lies in my assertiveness.

I think you’re right about the assertiveness part Simon
It’s good to see that you’ve taken peoples comments on board and not just reacted negatively to the criticism as so many people would, I think with that attitude you’re half way there mate so good luck
