Hi all, my TM asked me for my last 28 days worth of charts [i run analogue tachograph] as he said the company was doing an audit for WTD.
He photocopied all the charts, attempted to keep them and handed me the photocopies [4 weeks worth on 4 x A3 paper] and said, “if you get stopped, tell them we’re doing an audit”.
I stated that i would probably get done for failure to produce the originals if stopped as photocopies aren’t acceptable.
Where do i stand on this, is it legal to run with photocopies?
I though the TM was supposed to keep the photocopies.
If requested you must be able to produce 28 days of work records for any in-scope driving and other work in any week where you have driven an in-scope vehicle. These records must be in the form of either an analogue tachograph, a digital driver card or a manual record on either an analogue chart or an approved digital paper roll.
No mention of photocopies in the regulations, I would be pretty sure they wouldn’t stand up in court as an approved record!

Which audit does your TM think is more important, the one carried out by the company, or the one carried out by the person appointed by the Secretary of State for Transport?
I have a special place reserved in my Prohibition pad for folk that cannot produce the correct ORIGINAL records at a roadside check. Fear not , have an even better place in my Pocket Book for operators / agencies / others who cause drivers not to produce records at the roadside. The Pocket Book ones ALWAYS get to explain their actions to the Court, drivers - depends upon circumstances.

why dont you photocopy your tacho’s and give this to your TM and if he asks for the originals tell them he will have to get them from your dead cold fingers!
or if he already has them refuse to drive until he gives you the originals back as you will be breaking the law without them!
