About a month or so ago I parked for the in Sevilla on the fish market it was then that I noticed the fridge was not starting up I spent 10-15 minutes trying to start it but failed. It was then that I called thermo king 24 hour emergency number thinking they would send somebody out to repair it but no, they gave me an address in Sevilla so that if I drove round there their would be a mechanic to fix it. I explained to them that my time was up and had booked off for the night,they said when I got to the workshop they would give written dispensation to drive round there. I said thanks but no thanks and got my head down for a nights kip. Woke up first thing in the morning switched on the fridge and their she goes fires up first time,I switched the cycle mode off and let it run constantly till I got back to Madrid where it had a new starter motor put on. What would you have done risked it or got your head down?
I would say that if you had a perishable load on you might be ok, but if you were empty. But that’s only a guess.
It was July, and loaded with 20ton of frozen fish.
They should have come out . And any boss worth his salt should have made enough fuss that they would have complied .
Having said that if it was the only option i would have gone round .
They should have come out, but if I had a full load of frozen fish on (we load Bird’s Eye out of Bremerhaven) and my fridge broke down then I would take it to be repaired even if I was out of hours, I would say this fell well within Article 6, and that written confirmation of the necessity of the movement by ThermoKing would be accepted by law enforcement agencies anywhere.
Harry is correct try thinking what would have happened if your load had been
rejected because the hidden measuring unit had recorded too high tempture,
OR even worse instead of food you had chemicals loaded that HAD to be kept
COLD/COOL or they would react, sorry but you would have had right on your side mate,
