And That Is A Fact
Quite true - they upheld that they thought it reasonable of an employer to come to that conclusion BUT they also said that they found me NOT RESPONSIBLE for putting oil into the lorry and that I was a CREDIBLE witness.
It used to be that Solicitors would offer a free appointment to discuss your needs before taking on a case, maybe it’s worth phoning a few and seeing what you can find. It does seem a very complicated judgement from the Tribunal, almost contradictory.
Best of luck with it though and I do hope things take a turn for the better soon.
Just a point which is bothering me in all this, and thats the oil.
You say that only 3l was unaccounted for, but if that was put in a lorry engine which was to the max mark on the dipstick, it wouldn’t cause the seals to blow. You would need a fair bit more. Sounds like a garage issue to me.
We have run engines well over the full mark, due to the gradients they were working on, and have had no problems.

Thank you - that is the info that other ‘Experts’ have also stated - a 1 gallon overfill will not cause what happened - I’ve had my suspicions that this was down to the garage who are covering their backs

The drivers Responsibilty still to check it before you use it ?
And if overfull report it to the boss and if he sais it’s ok use it…
Leave the final decision to him.

Well they upheld the Sacking.

That seems exactly what the TRIBUNAL were also wondering but they did not have the power like a COURT to make a ruling on that.
Just to prove that some people do not read but others do - the training company where I had an interview and an assessment of my driving and instructional techniques today, laughed their heads off when they read the 11 pages of the summing up - they were as confused as all of us as (except one who seems to know better) as to the ridiculous outcome of this.
