The First 60?

Hi All,
I’m normally OK with finding the answers on With WTD & Taco rules, but one that keeps popping up and I will admit I can’t and will not answerer is.
Can you take a break within the first 60 minutes?

For the WTD regulations any break that is at least 15 minutes and interrupts the working time will count even if it’s 1 minute into the working time.

For the tachograph regulations if you drive for 1 minute and have a 15 minute break it will count as the first part of the 45 minute break.

In other words the answer to your question is yes you can take a break within the first 60 minutes and it will count.

The reason for this post is that some of the drivers leave the yard early to go to the quarry to sit until it opens. They record this as a break but I record this as a P.O.A. as I know what time the quarry opens
Any other penny worths?

Break or POA in that situation are both okay. The requirements for break are less than for POA so if a period qualifies as POA it will almost certainly qualify as break.

A friend of mine rang the traffic examiner & asked about this, he told me that as long as a vehicle has been driven it could then go back into the parking area & the driver could register his/her first break of the shift.

That’s only if you are going to use the break as all or part of the required 45minute driving break. If you aren’t you can take a break before doing any driving has been done, but it obviously won’t count toward a 45.
