If Steve goes to his consultant and gets him/her to write a letter to the medical people at the DVLA stating that his eyesight meets the relevant required levels for his licence. They have no right to deny him his licence.
He could take them to the European Court of Human Rights if Necessary,but I wouldn’t think he would need to go that far.

I think if I’m right that the quacks at the DVLA are supposed to be Consultants and their word is final.
I am at the moment waiting to find out if I have got to do another stress test for them.
My licence ran out nearly a year ago but because I have a letter vsection88 I can still drive, That’s when my consultant can be arsed to look at my file and say wether I can go back to work or not.

I was advised by my consultant and them at work to inform them in case I was involved in an accident and it came out about my condition then I would’ve been in the ■■■■.

as you say mate fight the penpushers DVLA have too much power best thing you can do is get all the proof together like you say and present it to them, if they still refuse to accept it then take it further do not give up, good luck chap

My consultant was adamant I was fit to drive, but the DVLA won’t take his word, they prefered to pay another independent consultant who reviewed my notes and who came to the same conclusion. Bit of a farce that they wouldn’t take his word, as he told me he regularly gets asked by the DVLA for a review of other peoples cases.

Sounds like the OP will eventually get his licence back, but the big problem with the DVLA is the timescale they work to, each step seems to take them several tedious months to process, probably quite normal for a 9 till 5 civil servant, but very frustrating for those of us out in the real world :confused:

So where did this “Information about your eyesight” come from?

Medical records are confidential. It’s unlikely they had access to them without your consent, suggesting they have acted on hearsay, and therefore WITHOUT that consent - and without any medical evidence come to that. :open_mouth:

Perhaps some disgruntled person has reported you for carving up their bike/drove past their Tory house in a country lane/revved their engine too near St Albans etc etc?

What they told the authorities amounts to false witness though, which is a criminal offence punishable by up to 4 years jail - should they be foolish enough to stand in court and commit perjury!
Tell DVLA that you intend to sue them, unless the malicious reporter is prosecuted by THEM for inciting them to falsely alter someone’s records without evidence or cause. :wink: It’s a form of slander apparently aided and abetted by DVLA staff, who at worst should have just arranged a free medical for you, and insist you turn up to “clear matters up”.

If they do insist upon another medical to get your licence back, then fair enough. They should be paying for it though at a centre near you, since it’s their ■■■■-up that you lost out in the first place - right? :slight_smile:

Feel for u m8 nearly didn’t get my hgv entitlement because my doctor done my eye test and filled the form in wrong luckily they sent a new form but I had to go to a opticians for the retest and passed with flying colours even tho I wear glasses my hgv dream was almost over before it even began hope it all works out Steve best of luck

The bods at the DVLA Med Section work to crib sheets for the topic, they look at several questions on a sheet of pre printed A4 form with yes/no boxs. They have to ascertain the aswers to those questions from information recieved, any questions that answer no or can’t be answered means a fail and your off the road, its as simple and as mercenary as that.

You have raised the option to challenge the decision in court, I looked into this and was put in touch with someone who actually succeeded in beating the DVLA in such a case, but once the ball was rolling the DVLA came out all big guns blazing and it was six years before it reached the Judge, only for the DVLA remove the licence again three years later.

I’ve been to the opticians today and had a check up and they say my eyesight and vision is more or less perfect. I passed the field test and the senlen chart, they say I don’t need glasses, my consultant at the hospital which is one of the main eye hospitals in the country has said in his opinion I’m perfectly fit to drive HGV’S after having 2 operations but yet some pen pusher who sits on their arse behind a desk all day has decided i’m not! :imp:
Work have been great and they are going to put me through my forklift test so I can work in our warehouse and still have a job. I’m going back to the hospital in October for them to do another field test and then send off the results along with a letter to the [zb] at the DVLA informing them I am going to appeal. I can see this being a long drawn out process as I know they don’t like to rush about and I am thinking of getting in touch with my union to see if I could have any kind of legal help. What gets me though is that I have been waiting for over 6 weeks for them to come to this conclusion in which time I have been driving all over the country in an artic. What would have happened if I had an accident in that time? could I have been in serious [zb] by the law due to the fact I have now had my licence revoked?

Hi Ben, I would be interested in knowing what the criteria is before the the Independent Complaints Assessor will take a case forward, is he just looking at cases where theres been a DVLA cockup? or as in my case where my Cardiac Surgeon catagoricaly stated from day one there was no worsening of my condition, an opinion that was eventually agreed with 18 months later by the DVLA appointed heart specialist. I lost my licence for 613 days :cry:

Thats an interesting govt. dept. as tomorrow I am in the London Heart Hospital for a visit to my consultant , the most eminent Professor for my condition in the UK, they have taken all my LGV entitlements including puddlejumpers and now they are wanting to take my car licence if they dont like the outcome of their investigations !!! I am seeing them the following week and its a consultant who qualified 6 months ago that makes their decisions I believe in my case, ( I checked up on his registration number). Has the world gone Mad.

You just have to fight them every step of the way. They tried for 13 years to say I wasn’t fit to drive HGV, wouldn’t grant me a provisional. They finally caved in last year, and had the cheek to back date the provisional to 1999! Nothing had changed with me medically, I have a heart condition that has never caused me any problems and has never got worse. Ironically, I had a heart attack and they still gave me my licence. I wish there was some way to make them pay for wasting 13 years of my time.

Hi. Yes the procedure is as follows:- Complain to the dvla hgv licence department. then complain to the customer services at dvla, then go to the I. C. A. Then if no joy go to your M.P. and ask for the form to fill in to go to The Parliamentary Ombudsman a copy of the procedure with them is available on www.ombudsman.org.uk If you require any more info just quote me on here and ill get back to you asap. No I had cardiac problems that turned out with no problem, they also sent me for a cardiac exam, but was better than it was 2 years ago because I lost 4 stone, they also sent me foe eye test passed with flying colours, my assumption is I paid money for an HGV medical with my GP and passed whats the bloody problem then. Its age discrimination, and the DVLA HAVE DENIED YOU THE RIGHT TO WORK remember those words.
