Taxi drivers ( london)

heard today that the london taxi drivers have won a case concerning the WTD.if they are sitting in the rank waiting for a fare then this is not counted as working time or any other time i.e. other work.if this is true how do you think this could affect us as truck drivers concidering the amount of time we can spend in rdc’s etc.so if you spend 1 hour or 10hrs at an rdc then it does not come off your 48hr week, only when driving.christ if this is true (and please someone from london give us some help),OUR TONY WILL HAVE A HEART ATTACK

KK as far as i am aware that will be the case for truck drivers to in the wtd im not 100% sure but i think it is the case.

if that is the case jammy,y bring in the wtd in the first place  would this not defeat the purpose of a 48hr week

surely Taxi drivers being self employed & thus not paid (working) if they are waiting puts them in a differnt situation to employed drivers who are paid, or should be getting paid whilst waiting to load / unload.

Periods of availability do not count towards the working week, i could be wrong but thats the way i read it!!.

I get the feeling we will be leaving it in break all the time and only driving being recorded, therfore coming under the maximum working hours under WTD

That would be illegal ralliesport unless all you do is drive (no daily checks or paperwork?) and rest but you might have to use the crossed hammers to identify periods of availability. Some of the other times PoA might be relevant:-

When broken down waiting the arrival of rescue/recovery operator.

When arriving for work and your vehicle is not ready/loaded.

When delayed beyond the usual time at a regular delivery/collection point.

I remember something about having to be told about the delay before hand to qualify as a PoA but I’m blowed if I can find the reference now.
