hi my mate want to know when a company takes over your company are you bound by the workforce agreements in place at is new company and should you be told of these
there a workforce agreement in place at is firm for the 10 hour night rule and lately he be starting at 3 am and did not know of such an agreement and as began sticking to the working time regs I.E. working 10 hours max
so my questions are
should he have being informed by is new employer of such an agreement in the take over process which was 12 months ago
is he bound by the agreement
can he ask for the agreement to be re voted

As to weather or not the workforce agreement is carried over to the drivers who are taken on when the company is taken over, I’ve really no idea but would imagine that it would be legal.
The agreement should be in writing and your mate should have a right to see it.
I guess it could be argued that if the agreement is in the name of the main company and your mates company kept it’s own name when taken over then he and his colleagues aren’t part of the group the agreement was signed for, weather or not he’ll get away with that I really can’t say but good luck to him anyway

cheers mate for that, he received a copy of it and it was signed by 6 workers out of 100+ 2 days after the RTD/WTD came in
