Can anyone advise me what the legal position is if i take 24hours rest very soon after a45hour rest period?here is an example-I take a 48 hr rest period between 12.00 saturday and 12.00 monday,i start first shift of new week 12.00 monday in which i do a 13 hour shift finishing 01.00 tuesday-due to work being quiet i park up until 01.15 wednesday-a rest period of 24h15min.Can i continue working another 5 shifts after starting 12.00 monday-say until 12.00 sunday then take a 24hour rest period or is the slate wiped clean so to speak meaning i start another week after starting 01.15 wednesday which means i must have 45hours off after 6 shifts. Looking at this scenario from a different angle could the 24h15m rest between 01.00 tuesday and 01.15 wednesday be used to compensate a reduction in weekly rest from a previous week e.g.a shortfall of 15 hours which had to be compensated could be added onto a daily rest period of 9 hours.How would the above situation be viewed by vosa/police?

You seem to be asking two different questions here.
- If the 48 hours weekly rest is to count for the week in which the rest period ends, then you have a reduced weekly rest on Tuesday/Wednesday you can then go 144 hours before needing another weekly rest or reduced weekly rest starting no later than 01:15 Tuesday of the following week.
If the 48 hours weekly rest is to count for the week in which the rest period begins then you have a reduced weekly rest on Tuesday/Wednesday you can then go 144 hours before needing a full 45 hour weekly rest period starting no later than 01:15 Tuesday of the following week.
- You could if you wished use the 24.25 hours as a reduced daily rest (9 hours) plus 15.25 hours compensation for a previously taken reduced weekly rest period, in this scenario you would need to have a weekly rest or a reduced weekly rest starting no later than 144 hours from the end of the weekly rest period of 48 hours.

Once you have had your reduced weekly rest (Tuesday into \Wednesday) you are free to work another six shifts. Your next weekly rest would not neccasarily have to be a full 45 hours either. If you just remember the criteria of having a reduced rest and a full rest in any consecutive two weeks, then there is nothing to stop you squeezing in more reduced weekly rests in that period if you can.

If he’s driving in the UK I agree, however there does seem to be some suggestion that more than 6 shifts may not go down too well in other EU Countries so until such a time that we have confirmation that other EU countries are interpreting the regulations correctly it may be best to play safe when driving outside of the UK
