Is it against the law to issue a driver with a box of taco’s and say ok, hand in the ones older than 28 days, then place these charts on a peg-board in the office?

I mean law here, Im not in the slightest interested in whether it’s a desireable or common practice or not, or who does what ect, Im interested only in the legal aspect of if doing such is actually against the law, thanks!

Breaking it down, is it illegal to -

  1. Issue a driver with a whole box of tachos?

No, an operator only has to supply sufficient quantity of charts to the driver and there is no upper limit.

  1. Ask them to hand in those charts older than 28 days?

No, in fact they must be returned within 42 days, counting from the day after the latest date to which the chart relates.

  1. Place the returned charts on a pegboard in the office?

No. They must be kept safely for1 year and if the pegboard is safe and the charts are not going to be damaged then no problem.

However, if they are just placed on the pegboard as soon as the driver returns them, and nothing else is being done with them, that could be an issue. The operator has an obligation to make regular checks of the charts to ensure the driver is complying with the regulations and if this isn’t being done then that could be a problem if subsequent checks show infringements.

Which bit of this did you think may not have been legal?

I didnt think any of that was illegal, but someone has been trying to tell me it is, and that Im a dinosaur out of date with regulations! Ive been told that the unwieldly, time consuming and actually unworkable system thats going down where I work has to be that way because its the law. I didnt think so, but wernt sure. :sunglasses:
