A driver with who i work with insists that it is ok to eject tacho whilst on break to check how long he has been on break for, in other words when waiting in a que he will pop the drawer open move forward and re insert card then gaining a 15 min break. I keep saying i cant see that been legal as it will show on your chart that it has been opened and therefore cancel the break. Any thoughts on this guys, i think i am correct.

Its not allowed, especially not moving without it in. Tell him to buy an hours timer!!! You would maybe get away with it once in a blue moon but not all the time!!! And even then opening it you would need a good excuse to write on the back, and would opened to check time wash?
Tell him to keep on doing exactly what he is doing, he’ll find out one day how right or wrong he is. If your boss was even halfway good at his job he should have spotted that carry on by now.
I suppose he should have spotted this by now as i know it happens with more than one driver. Hopefully these people will be caught out soon but i find these sorts of people usually get away with everything. I guess i should carry on doing what i’m doing working as a proffesional and let them get on with it, bloody amateurs trying to save a few minutes here and there just do the job properly!

No no no they are coasters.
When there ejecting there Tacho Drawers for the card to pop out it still isnt marking as break so it doesnt make any sense? Everything that he/she is doing is illegal… lol… Driving lorry without a valid card in, not showing break, tipping/loading off the card etc etc… Tidy.

If he’s moving forward whilst the chart is removed then he’s driving without a tachograph, worse still he’s claiming it as break.
He should start planning what he will say if he gets to meet the TC one not so fine day

Especially as he has moved into falsifying records territory. Level 5 fine, up to £5000 and/or up to 2 years in prison, which is why I said let him continue as he is, he’ll find out one day how wrong he was.
Ask your colleague what part of the following he (she) doesn’t understand?
You do not have to say anything, however it may harm your defence if you do not mention when questioned something that you later rely on in Court. Anything you do say may be given in evidence…I have a book full of questions that I might want to ask them, I also have a book of peoples answers, they make fascinating reading before the Magistrates or the TC

so this guy ejects the tacho tray while at say some traffic lights? the moves off and doesnt put it back in for anoter 15 mins so it counts as break? or have i read that wrongly?
