Tacho Violation Report

I am showing a weekly rest violation on my tacho report which i cant get my head around.

Here is what I did:

Friday 20th June - Wednesday 25th June - Rest
Thursday 26th June - Saturday 28th - Driving
Sunday 29th June - Rest
Monday 30th June - Saturday 5th July - Driving
Sunday 6th July - Rest
Monday 7th July - Driving
Tuesday 8th July - Thursday 10th July - Rest

The software is saying that I should have had a full (45 hour) rest period on 6th July when I only had a reduced (24 hour) rest. I think what I did was correct, as in any 2 fixed weeks I had one full rest period and one reduced rest period. Can someone please clarify?

From the information you have supplied you’ve had 2 x 24hrs in a two week period,

From what I gather about reduced rest and its been explained to me as the following

week 1 - 45hr
week 2 - 24hr - reduced weekly rest
week 3 - 45hr

I fully agree that “Any two consecutive calendar weeks must contain at least one 45 Hour Regular Weekly Rest”, but I have done that:

16th June - 22nd June - 45 hour regular weekly rest
23rd June - 29th June - 45 hour regular weekly rest and 24 hour reduced weekly rest
30th June - 6th July - 24 hour reduced weekly rest
7th July - 13th July - 45 hour regular weekly rest

yes they are correct 2 reduced breaks in a row, fixed weeks for tacho regs sunday 0000 to sunday. that’s the problem it appears both breaks started before midnight on the 2 sundays :sunglasses: :sunglasses: :sunglasses:

Where does it say in the regulations that you are not allowed 2 reduced weekly breaks in a row? All it says is

"In any two consecutive ‘fixed’ weeks a driver must take at least:

  • two regular weekly rests; or
  • one regular weekly rest and one reduced weekly rest."

To me it looks like the 29th reduced rest and the 6th reduced rest has triggered it, even though you have had lots of time off you haven’t conformed to the pen pushers rules.

As I see it its not about the weeks or the dates it’s the continuous shifts rule that has been triggered
Though I am assuming 29th & 6th are both 24 hour rests

I think you are correct that is what has triggered it. What I cant find is where in the legislation that comes from? All I can find is where is says in any two consecutive fixed weeks you must take either two regular weekly rests or one regular rest and one reduced weekly rest. I have done that. In fact there is only 1 week where I have not had a full 45 hour weekly rest.

If those are your correct weekly rest periods and the reduced weekly rest periods were at-least 24 consecutive hours, there’s nothing wrong with it, the software is wrong.

What analysis software are you using ?

Yes I drove on 7th July.

Where is the problem? Yes I had 2 reduced rests in a row, but as far as I can see there is nothing in the legislation disallowing that providing that you also have at least one full 45 hour rest period in any 2 consecutive fixed weeks.

That is what I am thinking, just wanted some clarification.

That says the same as I posted before:

I have met this criteria.

Yes but read the rest as you have to compensate the next by taking a 45 weekly rest
