Thanks for the answer’s on this topic, I have now spoken to the other driver and advised him that he was incorrect - which to be fair he took very well and admitted that he must have been doing it wrong since the rules changed !!
Now though he has come up with another one which I haven’t got a clue about, he states that you cannot register a tacho break until you have completed your first hour of work ? By this he means that if I was to start work at 7.00am and drive for approx 30 mins, that if I was to take a 15 min break that this does not count towards a split break as I will have done less than 1 hrs work ■■
I’ve no idea on this one as I have always had to travel a lot longer than that before I could even think of taking a break !!

He’s wrong again
You can take a tacho break any-time after there’s driving recorded on the tachograph chart/card, which in effect means after driving for 1 minute.
Perhaps you should suggest to your friend that he either comes here and does some reading or downloads and reads GV262.

You have learned something very valuable about this driver, if the subject is tacho rules and his lips are moving he is talking crap. Seems he subscribes to all the myths and bullcrap about the regs. If left unchecked, expect him to tell you shortly that you cannot do two 10 hour driving days back to back, you can and in fact it is possible to do 4 in a row. He is also likely to tell you that you cannot take a 9 hour daily rest at home, you can, and that you must have 30 minutes break after 6 hours work. You don’t, 15 minutes will suffice. If he is a real professional bullcrap merchant he may come up with the classic - if you take a break before 4.5 hours driving you lose the remaining driving time from that 4.5 hour period. You don’t. Don’t believe anything he tells you regarding the regulations without double checking it first. You may also consider recommending he applies for a job as a transport manager or a trainer, he seems qualified for both positions.
