Tacho Question

I recently delivered a new trailer to a customer, from the north east of Scotland to Worksop. My driving hours were fine as I sat and waited for the trailer for 3.5 hours. However I put the tacho in at 13:00 and I reached the final destination at 04:05, thats 15 hours 5 mins, so I’m over my insertion time by 5 mins. I thought the people I was delivering the trailer to would let me sleep in their yard as it was huge and I would be over by just 5 mins which in my eyes isn’t the crime of the century. This wasn’t the case though, they told me to drop their trailer and find somewhere else to park which ment I had the card in until 05:00 until I found the nearest layby which lucky enough had a little chef and toilet and burger van next to it, thats an hour over the insertion time though. Now the question, is it ok to write on the back of the card ‘‘Insertion time exceeded due to inappropriate parking’’? or is this just acceptable with driving time?

The max VOSA FPN for insufficient daily rest from 15 mins to 1 hour is £60 - between 1 & 2 hours is £120 - Nowt else - just the fine - so that takes care of the possible nasty bit

Vosa will expect you to still have the required daily rest albeit running 1 hour late.

After 6 months VOSA cannot do you for it - so fingers crossed that you don’t get a tug

If you do get a tug then it will be up to the VOSA person as to how they view it - perhaps geebee45 can throw some light on this… they may ask the question - why didn’t you call ahead to find out about where you could take the daily rest?

Thanks Rog, was just wondering if writing that on the reverse side would lighten the blow if I do get pulled up about it, which isn’t un-true just to get out of it, thought I’d just made it and it was my first time south as well so didn’t have a great knowledge of where to go when I was turned away lol. I had 11 hours rest and was moving again at 16:03 the following day.

I was wondering if you’d get away under the ‘split daily rest’ rules? I think you’ve got to take 12hrs in under 12hrs with them though? ie a 3 and a 9 in under 24hrs from your starting time, so that wouldn’t help?

That still only gives you a 15 hour shift though (with the 3 somewhere in the 15). And how do you take 12 in less than 12? :stuck_out_tongue:

1300->0500=16. You could do it with the old rules, but not anymore

I’d have taken the trailer with me - the time it takes to drop it is time you could have been looking for parking :wink: :smiley:

Because of the 3.5 hours while you were waiting for the trailer I would have been planning where to stop. You could have had a meal on the way down and a proper rest and drop the trailer in daylight the next morning

It was supposed to be ready at 2 o’clock but i didn’t get it until almost 5. I’ve never been down that way since I’ve had my LGV licence,only when I was small with my dad so I couldn’t plan stops, even though I had a rough idea of where to stop nobody told me about the road works at ■■■■■■■■■■■ and on the A1, so I would have been behind on my time.

So you were at work from 0930 one day to 0500 the next ?

Do people still do that these days ?
