What you have managed to do right here mate is…confuse the [zb] out of me!!
And witch bit are you confused with??
Wherever you had the weekly rest in the EU has no bearing on the driver regs regarding weekly rest.
Daily rest does not need to be paid back - only weekly rest.
All that I need to know is when did you take any weekly rest over the last 3 weeks and for how long was each weekly rest period - unless a GURU can decipher what you have put in your OP !!
Dava:
i had 38 hours off in macon (36 hours)
why have you put 36 hours in brackets ■■
Erm… all of it!
What days did you have off?
What days did you work? and how long?
From when to when at Macon?
Write it all again with the days.
Looking at it again…i wouldn’t worry too much, sounds like you had more than enough time off, but i do think you may have confused yourself, when did your 2 weeks begin?
i had a week off work from the from saturday the 10th to monday the 19th did a trip to spain parked up at macon saturday afternoon 36 hours off then 24 hours off during the week last week and then 65 hours off this weekend gone

Full weekly rest for W/C 19 Oct
Reduced weekly rest for W/C 26 Oct - 36 hours off so 9 to pay back
24 hours off during the week which can be 11 of daily rest PLUS the 9 paid back so all level
Full weekly rest W/C 02 Nov - 65 hours so took 20 hours off more than the legal requirement of 45
All LEGAL and NOWT to pay back

There is a legal alternative to this depending on which week you count the weekly rest in -----
Full weekly rest for W/Commencing 19 Oct
Full weekly rest W/Ending 01 Nov

That is someone getting mixed up with the old pre 2007 regs and adding a few of their own rules !!
It is now simpler…
A full weekly rest is 45 hours or more
A reduced weekly rest is anything between 24 and 45 hours but has to have the reduced time paid back before the end of the THIRD week following the week in which it was taken (that being fully paid back by sun 2400 of the fourth week)
That’s it

This is for EU regs 561/2006 if on AETR then they are different
I have all the paper work on the new driving regs and a book off foster tachos and the new drivers hour gaurd arrived last week so i should be all well and good soon i hope
