I parked up early quite a long way from base today. I put the tacho on rest but after about an hour I had to move about 2 or 3 foot to let somebody out then forgot to put it back on rest. I only noticed 3 hours later by which time I’d gone over my 15 [emoji22]
Anyway, I wanted to take a 9 off and get back as I’ve only got a couple of locals then home nice and early.
My dilema is do I take 9 off from when I first put it on rest and get another infringement for not taking 9 off or take the 9 and start later than I wanted to?
Obviously I’ll be doing a printout and writing on the back to explain all this.
As far as i am aware, there is no choice here…
Why have you not removed your card when you started your rest…?

Assuming you left your driver card in the tachograph, if you take 9 hours rest from when you first put the tachograph on rest you will not have had 9 consecutive hours rest because you later moved the vehicle, so if you get stopped by the DVSA tomorrow you could possibly get parked up for 9 hours.
On the other hand if you count the 9 hours rest from after you moved the vehicle you should be OK as long as you do a printout with a written explanation that you forgot to put the tachograph back onto rest after moving.
Either way you’re going to get an infringement, you just have to choose whether or not it’s worth the risk of getting parked up.
I’m not saying the DVSA would park you up for 9 hours just that they could.

I’m not overly fussed about an infringement because I don’t take the ■■■■, in fact, I haven’t had one for ages. Just wondered if DVSA would take a dim view of me not taking a 9 after realising the mistake.

I ain’t an expert on this type of hours and infringements crap by any means, but I do have a bit of experience with VOSA/DVSA, having driven foreign trucks in the past,…and I can honestly say that on the whole they have been fair with me 99 times out of 100, as soon as they realise that you are not some regular offender or ■■■■ taker.
As I said, don’t believe all this crap that some firms want you to believe to keep you on your toes,…you ARE allowed to make mistakes, and if those mistakes are infrequent and genuine you will be on the whole fine.
VOSA do not OWN you just because you drive a truck.

When was the last time you even spoke to the DVSA? It’s probably one in a million you will even be stopped in the next 28 days.

Just tell whoever that you’re unilaterally back-dating the proposed relaxation of drivers’ hours as part of your civic responsibility in the fight against Covid-19.

True, up to a point (In my VERY limited experience, admittedly)
30 years gap in driving jobs, started last year again, Agency.
Spent 3 weeks ■■■■■■■ pallets around for a firm in Park Royal, no probs, decent blokes.
AFter the first day photocopying of my 3 cards they had no interest whatsoever in my tachocard.
Never even downloaded it after my 3 weeks was done.
I used to put it in the machine in the morning, take me 45, take the card out at night. No manual, nothing.
Second firm, Yeah, John Lewis. Absolutely [zb] hot on WTD and Drivers Hours regs.
Multiple infringments got me interviews galore in the first 3 weeks. Basically, wrong button pressed type of thin gs.
15 months later, went over WTD by 1, yes ONE, minute. Tacho was fast by 5 minutes, I forgot about it, took it to the wire, BOOM! Hammer came down.
Did the same the week after.
Couple of months later I am at a new job because they made life so bad that I couldn’t carry on.
Anyway, what I’m trying to say is that it’s down to your firm how seriously they take it.
First day on me new job, out with another driver doing veh recovery.
He forgot to put it on break, we worked through the day.
Obvs WELL over WTD by HOURS.
No probs. He got called a [zb] in a joky way by the manager, and we moved on. No hassle.

Was the truck moving on its own while you were resting if not then there is nothing to worry about
You do know it will show you only moved a few feet
I wouldn’t risk trying to blag the hours rest you had before you moved, but would have no problem doing a printout with a wee story about what a dilatory ■■■■■■■■ you are for forgetting to change the mode switch, and, after nine hours have elapsed, crack on.
