Tacho exempt info wanted

Right guys i have a friend who asked me this question. He has just started a job driving a hock loader and only carries chicken litter (■■■) from poultry farms to farmers fields. The company he works for says he does not need to use a tacho■■? as its category 2 ■■?
I have looked it up and vosa website sorts of backs this up.
Can anyone on here confirm tacho or no tacho

Hiya your mate should have at least a log book i thought. i had a pal who drove and offal wagon
who run on a log book, he also wasn’t aloud to stop on msa,s. or have nights out when loaded.
he loved it but what a stink.

I would think the job would be exempt from EU regulations under the animal waste exemption, I can’t find an exemption from the domestic regulations though.

Vehicles being used to carry animal waste or carcasses that are not intended for human consumption

National Exemptions under British Law

Vehicles used by agricultural, horticultural, forestry or fishery undertakings for carrying goods within a 50 kilometre radius of the place where the vehicle is normally based, including local administrative areas the centres of which are situated within that radius.

Vehicles used for carrying animal waste or carcasses which are not intended for human consumption.

If within 50 km of base then I would say its exempt tacho/EU regs and be under UK domestic regs …

Thanks guys, Thats what i read rog on vosa website. It is chicken waste. He does a log book every day and he only works a 10 hour day and yes rog he only travels about 40 kms of his yard.

Yeah, I think it’s called Cat. 3 ■■? I also know someone who runs this type of load on Domestic Regs./log book. I’m sure he’s allowed to ‘crack on’ & not take a drivers break so as not to cause a public safety risk - or some such reason. I’m sure he’s not limited to the 50 km radius. Problem is he does some backloads when he falls in-scope of EU Regs. so it can get messy - in more ways than one!!!
