I decided to give PSV a go and got a job with a bus company. I was told I had to surrender my Tacho card as they work domestic rules. At the time of the interview they said that I would receive another if I left the company.
Talking to a friend recently he said that under no circumstances are they allowed to do such a thing. Presumably it is to stop me working agency at weekends but if my hours allow there is no reason why not. I suppose they don’t want to have to check it every Monday which they would be obliged to do.
If I was to leave the company and they didn’t return the card. I could apply for another saying it was lost. I could work for 15 days keeping a manual log… but I wouldn’t get the job then in the first place.
As I understand it - it is my property and they are not allowed to destroy it - what should I have done in the circumstances. Perhaps they have just put it in a cabinet… i.e. just storing it?
First things first ! the card is property of DVSA not you or the bus company
2nd you should not of handed card over to them ,
3rd fill in form for new one and tell them they’re paying for it
4th leave the job when you get new card as if they’re that paranoid they’re not worth working for

4] had another job offer which I think I would be wise to take… but without the tacho no go.
Just tell them you’ve reported them to the DVSA and they’ve told you it’s their card which the bus company don’t have any legal right to hold it - might scare some office bod without much clue into sending it back to you asap.
If you really want to scare them, tell them that disposing of it would be falsifying driving records and you’ll inform DVSA if they don’t return it asap. Probably wouldn’t be, but it’s all about making them think twice especially if they think VOSA / DVSA might look down on them and getting it back. Oh and then tell them to stick the job!
