I have been on the sick for a few weeks, in the process of havin some tests
My boss is paying me ssp but not happy about it as he say it is costin him money I said he can claim it back on his Tax next yr , but the TM disagrees with me and says he cant now 
It is also not that busy at the moment and boss is talking about layin drivers off how do I stand on this?
Yes I have discussed this with other people and they say I am right
dont think you can be laid off while on sick, unless you have had x amount of time on the sick…
not 100% though.
as for ssp I always thought it was paid by the state but perhaps its not.
SSP is reclaimed from the govt.
He cannot sack you while on sick but he can make you redundant. You dont make the person redundant but you do make the position redundant.
So if he gets rid of a few drivers as long as he doesnt recruit any more the next week to replace them then you dont have a leg to stand on.
Being on the sick doesnt make you immune from redundancy and being on the sick is likley to make you a target.
Also redundancy doesnt have to be justified. I.e. he doesnt have to work a last in first out policy.
