Hello quick question.
Can a driver split his daily rest period whilst working through the night?
For example - I am currently accumulating 11 hours duty per night - a mixture of driving & other work. I take a 4 hour rest period during the night as well as a 9 hour rest period at the completion of my shift.
seems legal to me…providing there is a collective or workforce agreement in place to ‘opt out’ of the WTD 10-hour maximum night shift working rule (the only opt-out available to mobile workers).
Also be aware of not exceeding the 60 hour max. weekly working time & having to bring the average down to 48hrs over a 17 or 26 week reference period. These hours don’t include breaks & POA’s, just driving & other work.
This should be monitored, planned & complied with by the operator/company.

The 10 hour night rule is for working hours (driving + other work) and not shift length
Thanks very much for your replies. I feel all clever now because I worked it out for myself and got it right for once - confirmed so by your good selves.

Can anybody tell me if this is legal please.
Thank you.
Yep but the WTD still applies. 48 hr week averaged over probably 17 weeks, with a max of any week at 60’hrs.
Nobody gives a ■■■■ normally until an accident occurs then then crap falls on you !

Should be monitored, planned and compiled, you mean stick it on poa at every conceivable opportunity ,never used it before, but getting the hang of it now,15 hr shift today,1.5 hrs break + 7 hrs poa

Going to totally legal. Your working time of 11 hrs is that after you take the 4 hrs break or before just curious
As the maximum shift time possible is 15 hours how can it be 4+11 or 11+4 ■■?
sorry rog just read that and it didn’t make sense, what I ment was, is the 11 hrs working the total for the night or is the op saying that he is only doing 11 hrs work, but a the max 15 hrs duty less the 4 hrs of break to equal 11 hrs if you get what I mean.
