Hello people sorry for asking this but im confused as to whether I can do this or not.
I want to work Thursday on the agency but I am not sure if I am ok to do so with my current job.
The hours my current job is as follows
Monday 21/09/2015 19:00-23:00= 4 hours
Tuesday 22/09/2015 18:00-22:00=4 hours
Wednesday 23/09/2015 09:00-19:00+10 hours but 1 hour = break so I work 9 hours
Thursday 24/09/2015 DAY OFF
Friday 25/09/2015 19:00-23:00=4 hours
Saturday 26/09/2015 09:00-19:00=10 hours but 1 hour=break so I work 9 hours.
Sunday 27/09/2015 DAY OFF
That totals 30 hours in my current job which is driving the Tesco home shopping vans.
The vans are not tachod up as they are only 3.5 tonnes.
Can I work this thursday or not?
Any guidance would be greatly appreciated
Thanks Thomas
Can’t see a problem with that. You should be able to work legally between 4am Thursday and 10am Friday.
Think I’d be inclined to keep it quiet from Tesco’s though, they might not be happy about it.
Don’t be sorry for asking, that’s what this forum is for.
Yes you can. As Wingnut said you cannot start any earlier than 04:00 on Thursday morning and finish 10am Friday.
Because of the time you finish on the Saturday and start again on the Monday you get 48hrs off so you can do the Thursday every single week or you could choose to work Sunday and use Wed 1900-Fri 1900 as your weekly rest period.
Because you are not subject to EU Drivers Hours Rules on Monday/Tuesday/Wednesday you do not have to have a rest period as such before driving on Thursday (it would be wise to have a full rest though) - but as has been suggested you will need a daily rest period - at least 9 hours - on the day you do drive.
Also as has been stated already, you will need a weekly rest because you have driven during a fixed week - but this is covered with your Saturday night to Monday night rest.
HOWEVER - make sure you carry records of any work carried out on any day in that week prior to driving on Thursday. These records should be an analogue chart, digi print out or manually entered onto a digi card and must be a minimum of name, date, start time & finish time and signed if written. Most cases you can get away with a time sheet or diary etc but these aren’t officially records.
And of course don’t forget any legally required records from the previous 28 calendar days. Failure to produce these records on request ‘could’ be a £300 penalty and prohibition.
The days working in your other job don’t count towards the WTD(RTD) anyway so no worries for working hours.

No tacho? U cud wrk 24/7 no one is ever going to know , crack on drive
+1 i know i would , if driving anything not fitted with a tacho then the driver hours don’t really come in to it,
If something occurred and the DVSA checked with the HMRC tax records database to find out you had not recorded the other job then that puts the driver in very hot water
If the other job was paid off the books then a driver is likely to get away with it
Right so the thought occurs to me to get a steady van delivery job that pays just under what I earn now and then work class 1 for 3 days so I can work 7 days and earn a “living wage”
