Someone parking on my drive

We keep getting someone parking their piece of crap Polo on our driveway, I’m seriously getting ■■■■■■ off about it, doubt the police will do jack about it so I’m tempted to smash their window in and push it onto the road…
Last person who kept parking across the drive ended up with a large glass of ■■■■ in the heater vents…

What Happens If Someone Parks On Your Drive?

Let’s imagine there is a stranger’s car parked on your driveway. It’s fully road legal, it’s taxed, it’s in date for it’s MOT and has been there for two weeks.

Your local council have no power or authority to remove a vehicle from your driveway due to it being on private land. Considering the vehicle is trespassing, you’d think the police would be able to do something about it? Wrong, the police are more likely to chalk it down to a civil offence which holds no bearing in criminal law.

What Can You Do About This?

Your options are very limited when dealing with this.

The only time the council will remove the vehicle is if it is abandoned. To be classified as abandoned the vehicle needs to be untaxed for at least one month and left in the same location for a long period of time.

You can’t cause any damage to the vehicle so scrap that option straight away.

Do not tow vehicles parked on your driveway

You could pay over £100 to tow the car away but this might cause damage to the vehicle where you would be liable to pay for any damages.

Police have advised in the past “Don’t damage or clamp the vehicle or have it removed by a third party for destruction or storage without first seeking legal advice.“.

The only legal way to resolve this issue would be to obtain an eviction notice from the courts however this might cost you a hefty amount of money. The court would process the order for removal which leave you with legal fees that could tally up to thousands of pounds.

Or find out who owns the car and go round and shag his wife

I believe if you block someone in your own drive it is imprisonment or something similar

So if said “illegally” parked car is blocking you in on your own drive, ie you cannot get OFF your drive, is that classed as imprisonment and would it make any difference to your case ■■ Just asking Tyneside

You’re not imprisoning them. They can walk off whenever they want.
You might be blocking their car. In fact a wall of single breeze blocks might do it? If they touch or damage your wall…?[emoji3]

Stopping entry is no problem.
Stopping exit is obstruction.

This post reminds me off airport car parking and fake websites, with images of safe and secure parking, a well dressed and polite individual taking the car and keys off you , only to park it anywhere, but not where it was advertised online.

The car gets multiple parking fines, vandalised and used when you are on holiday , and speeding fines in the post. In some cases the cars were left unlocked with the keys left in it, if anyone parked on a residential street, locals would write notes saying; If you can afford a holiday, you can afford to park.
Cars had their tyres cut and smashed windows.

They can’t park on ours cos gates ( :bulb: for you), but anyone blocking said gates will find their car several hundred yards away.

This is one of the results of clampers being banned, low lifes think they can park anywhere they fancy.

If it was my drive he was parking on I’d approach him and ask him to stop doing it with immediate effect. Depending on my mood I’d probably approach him whilst naked and preferably sporting an erection because believe me nobody wants to fight a naked and insane man. :wink:

Some years ago I had a similar situation once when I needed to get to work. Some idiot had parked a Fiat 128 across my exit from my ■■■■■■■■■■■■. The street was packed solid with parked cars and, presumably, said idiot took a chance.

I honked and asked around to see if anybody knew who the owner was. Nobody did. Nobody responded to my honking. The driver had left a gap of about 1m20 so, ever the optimist, I gave it a go to see if my Defender (in low 1st…) could squeeze through. It could’nt but did accidentally move said Fiat enough for me to get out (“scraping” his rear wing and back door in doing so). Another silly accident.

The owner suddenly appeared and I apologised profusely and offered my insurance details. Plus I gave him a friendly but frank free horoscope reading. And asked if he wished to pursue the matter. He chose not to.
