I have never really been bothered by people smoking, if they want to do it it is up to them. One of our drivers does smoke or used to anyway but he never smoked in the vehicles, that isnt allowed. Even if there wasnt a law about it i still wouldnt allow smoking in the trucks, but thats down to each company. Going round and taking photos seems a bit extreme!
Here is the letter wot I wrote to him…

I am writing with regard to a letter received by my employer, Fleetwood
Transport about the Health Act 2006, following a complaint from a witness
that I was smoking in the vehicle GN54CYO, an articulated lorry tractor
unit. Your reference is ENF-SMF-08-0054My employer has passed on the letter for me to deal with.
I am the driver of the vehicle. This is not a pool vehicle which returns to
base every night, it is an allocated vehicle and is to all intents and
purposes my home, having beds, refrigerator, cooker, TV etc. I generally
live in it for five to six days a week. Last week, for example, I went to Spain in it.Nobody else ever drives this vehicle, or ever has driven this vehicle. I am
the only person who ever uses it. We are obliged by law to retain for 12
months tachograph charts recording the activities of the vehicle and any
driver and you are welcome to inspect these by mutual arrangement to confirm this.
Additionally, no passenger ever travels in the vehicle.This vehicle is therefore exempt from the Health Act 2006, as it is not used
by more than one person and I would be grateful if you would point this out

I am afraid that it is a standard letter and is used in all cases, even when further information is required. I have kept your comments on file, so that should a similar complaint be received, the complaint can be properly notified and no further action shall be taken against the company.Thank you once again for your cooperation.

just to add my two pennys worth, for what its worth yes i smoke in my truck not proud or boasting but its somthing ive done for years and a little sticker on my windscrean aint gonna stop me but i have stopped using a hand held phone and not got a open lap top on top of mw dash and neither do i now make a cuppa T whilst on the move
You could probably smell smoke in mine as i keep an ashtray in it, one of them chrome ones with a black push button top, i carry this so i don’t get done for littering when i stop and get out for a smoke. I take my rubbish with me.
I also use and carry one of these to limit my cravings…

A non smoker (like me) can always tell if anyone has smoked in a cab, but I think that if it’s your regular wagon that you should be allowed to smoke, after all it’s not like in an office where you can stop and step outside for 5 minutes If I have to drive your wagon(agency) I’ll open the window for a while, big deal!!!

thats allowed…but me smoking in my spotlessly clean cab which im in all year apart from the 20 days that im on holiday is not??
seems a bit ill thought out to me…yet again by minority groups dictating with no leverage for common sense!!!
bit like the pub arguement…they could of had smoking and non smoking pubs…but oh no…complete blanket BAN…and now look whats happened…if they’d have done the non smoking and smoking pubs idea…guess which ones would have been left…im pretty sure what the outcome would have been and we wouldn’;t of had the sad situation that we have now.

Well, whatever. The bottom line is that I have written permission to smoke in my cab from the Authorities so don’t trouble yourself if you see me smoking.
I’m not going to get involved in a willy-waving contest, but there are plenty of members on here who know exactly what my driving experience consists of, and if you imagine that your having two pieces of paper makes you more qualified than me to judge if my driving is safe or not when I smoke, then I am afraid you are very much mistaken.
FFS why does it matter, as long as the smoker leaves the truck clean and smelling nice for the next driver who gives a toss? And if it’s an allocated vehicle or a tramper’s vehicle then it’s their home for the week so they should be able to have a ■■■ in it. At my company (a subsidary of a yellow parcels firm) it’s gross misconduct to smoke in company vehicles and people have been sacked for it after being spotted by management from other sites in some cases. But that is down to them at the end of the day and certainly no-one else’s business but theirs. You must be some sort of sad case to have nothing better to do than to try and get people the sack. PS I’m a non-smoker and I’m totally AGAINST the smoking ban, I would have thought it sufficient to create a non-smoking area, be it the whole pub or just one room. The anti-smoking brigade DO NOT speak for me.
I smoke in my truck, and anybody elses one that i may happen to drive.
When on a night out, i open the door and pee over the step and front wing.
Any rubbish i may have gets deposited where i have parked, preferably in a rubbish bin, if there isnt one, i deposit the rubbish where there should be one.
Any newspaper supplements, i dont want or never asked for…gets dumped out of my window, along with chewing gum and wrappers…old ■■■ ends, and any other rubbish i dont need in my cab, such as mcdonalds, or burger king wrappers and drinks containers…the reason for all of this mess…is …i believe i am keeping someone in a job…
I tried that line with a “town centre warden” who caught me dropping a crisp packet on the floor. His reply was I was keeping him in a job and his job was fining me £30. I thought he was going to go off his box when I told him he could chuck the fine on the floor too.

Seems like it may be an offence to use a camera as well as driving? I myself support the ban, it helped me decide to finally give up smoking after 40 odd years. However I don’t advocate shopping other drivers. At the end of the day it’s their own affair. The company I drive for don’t allow smoking in the wagons or any where on the premises in or out of doors, and thats fine with me. Our wagons are double manned 24/7, and if I detected a driver smoking in my motor, then I would have a quiet word or three with him and hopefully resolve the matter(make him buy air freshener). My consience would never allow me to go running to the gaffers, especially in these straitened times.
I think the point made earlier about how it has all but destroyed the pub trade is very valid. Nobody is forced to go into a pub. A pub is the publican’s home and it should be for him to decide if smoking is allowed in his home, not the Nanny State. Pubs have become soulless places now, instead of being a place to relax and feel at home. They will be banning music in discos next.
It’s just yet another attack on the working class and our habits dreamed up by toffee-nosed twerps who never set foot in a pub. I will be voting Labour out next year purely on the strength of this nasty piece of control-freakery.
I can still have a drinka nd a smoke at my local, ok i still have to go outside for a smoke, but i can take the drink with me as im going out back into the beer garden area. though ill agree pubs arnt what they used to be since the smoking ban came into force, even worse in clubs cause all you can smell is bo and not smoke. i know what id rather smell tbh
