Smoking and the law

Can anyone tell me what the law is with regards to providing workers and drivers with smoking breaks?

If its in the yard do you need to provided a designated place or just tell them it’s outside the premises?

Do they need a cover or shelter?

As a driver, they can not smoke in vehicles, do you need to provide additional breaks?!

These maybe stupid questions but I’m unsure about what the actual law is, any knowledge or help would be appreciated.

There are no specific laws which cover your queries

Drivers can smoke in vehicles but usually only if that vehicle is mainly driven by one particular driver or all that drive it are smokers

COMPANY POLICY (not law) will dictate how things work for the smokers

I dont think you have to provide squat for them tbh, its nice having somewhere covered but if your a small company then its really a waste of money since its only useful when its raining/winter. A bin for ■■■■ ends is worth the money though…all we get is a plastic cup sitting at the gate with rainwater in it lol.

As far as I’m aware there’s no legal requirement to provide a smoking area of any kind nor is there a requirement to provide breaks other than those covered by the driving and WTD regulations.

Legally a vehicle that’s used by more than one employee and all of them smoke should remain smoke free at all times.

Smokers are legally governed by where they can or cannot smoke and have been for a couple of years now.

Whether or not it’s sensible law is another question but …

As a well seasoned smoker, I would question why I should be allowed a separate smoke break or god forbid a shelter.

We make a choice in life, my choice would be to go for a ■■■, while someone else may choose to have another cup of coffee, someone may want to read the paper, we all do it within our allotted time or in Harry’s cab.

When I go to the pub I probably go outside for a ■■■ about 10 minutes in an evening. I have tried to get an extra 10 minutes drinking up time, but that wont wash with my landlady. :laughing:
