small question...

Hi all. Have a small question about the half hour brake WTD.

So… BY 6 worked hours i gotta take 30 mins brake.
Lets say i start 7:30 am. By 13:30 i have to take the brake. But… if i take it lets say 12 midday till 12:30 when do i have to take the next brake? As far as i know i have to take it by the time the next 6 working hrs finish. Or it is in any other 6 hrs period which means anytime in the 7:30 - 13:30 period and 13:30 - 19:30 period?

you must if working more than 6 hours take a break or breaks totalling 30 min this may be taken in 2 breaks which must be a min of 15 min.
You cannot work more than 6 hrs without a break … that’s the golden rule if your working more than 9 hrs a 3rd break must be taken making a total of 45min.

A driver must not work more than 6 hours without taking at least a 15 min break - not 30
Work means driving time + other work time not shift time

Assuming you have only done driving and other work … no POA
starting at 0730 means a break of 15 mins if needed to start by 1330 providing a driving time break is not needed before that
Break taken from 1330 to 1345
Assuming a driving time is still not needed by 1945 then another 15 min break is needed

By 2000 a total of 12 hours work has been done so before the end of the shift - not right at the end - another break of 15 mins is needed as the total work in the shift has gone over 9 hours needing a total of breaks adding up to 45 mins

In most cases driving time breaks have been taken which means that the 45 total is covered and often means that specific breaks for RTD are not needed - breaks count for both driving time and RTD (WTD) with driving time break rules taking preference

If you take the first 15 min break at 1100 then the next 15 min break is needed to start by 1715 provided a driving time break has not already been taken between 1115 and 1715

ITS NOT A 30 MIN BREAK BUT 15 - if another has told you its 30 then they have informed you wrongly

You shouldn’t work more than 6 hours without a 15 minute break, so if you had a break at 12:00 to 12:30 you would need to start another 15 minute break no later than 18:30, that’s 6 hours from the end of the previous break.

When you have the required break of at-least 15 minutes it resets the 6 hours working time, so you could say you start a new 6 hour period every-time you compete a break of at-least 15 minutes.

Obviously this does not take into account driving breaks or the total WTD breaks that must be taken in the shift.

I was told (apparently wrongly by my then employer ) it was a 30 min break but it only counted as 15min towards my 45min “driving” break .has this been the case and things have changed ? the company concerned was a large outfit (ni based ) and I wouldnt have thought they would want 100s of trucks sitting idle for 15 mins longer than needed . or more likely I have completely missundertood the thread and I prepare to stand corrected . :confused:

Some companies insist on drivers having a 30 minute break for the 6 hour rule, the RT(WT)R don’t stipulate a length of time for the 6 hour rule break so it’s assumed to be the shortest break that will count for the regulations which is 15 minutes.

Legally you require a 15 minute break before exceeding 6 hours working time, but if you’re company insist on you having 30 minutes and you’re getting paid for it just make the most of it :wink:
