still confused as the xmas rush now approaches i normaly drive six days a week
can i work six days a week if my driving hours average 7 hours daily…If my daily rest amounts to 11 hours rest every day are all them 11 hours counted towards the weekly rest of 45 hours or should i be taking 2 days off to keep in line with the 45 hour weekly rest
also is it only driving that counts and not other work towards my weekly rest

You should have a 45 hour weekly rest each week, alternatively you can reduce the rest to no less than 24 hours every other week but the reduction must be paid back by the end of the third week after the reduced weekly rest week.
The daily rests do not count towards the weekly rest.
In any 2 consecutive weeks you must have either two full weekly rest periods or one full weekly rest and a reduced weekly rest.
The reduced weekly rest can be paid back by adding it on to either a weekly rest or a daily rest but must be paid back in one block.
Example: if one week you reduced a weekly rest to 36 hours you would need to add 9 hours to either a weekly rest period or a daily rest period by the end of the third week following the week that you had a reduced weekly rest.

A weekly rest period is the same as any rest period and means that you should not be working, driving and other work is still work.
Daily driving of 7 hours per day, 6 days a week, is fine for tacho rules.
11 hours rest per working day is fine as long as you mean starting work at say 6 am and finishing at 7 pm, (or whenever it is you start your shift).
Daily Rest is the time between stopping one shift and starting the next shift.
It should be 11 hours, but can be reduced to 9 hours 3 times a week.
Weekly Rest is the time between finishing one weeks work and starting the next weeks work. It should be 45 hours but can be reduced down to 24 hours, provided you had 45 hours last time. If you start your week at 6am Monday, then to get 45 hours rest in you should start your weekly rest no later than 9am Saturday.
(I used a 6am start to continue on my example for Daily Rest)
Daily Rest and Weekly Rest are two separate entities.
Also, a break (the short rest(s) during your working day) are not a part of your Daily Rest (except in one particular circumstance).
Hours worked consists of driving time and other work.
Break and POA do not count towards hours worked under tacho or WTD rules.
You have a 13 hour shift, because you say you have 11 hours off every night.
You drive for 7 hours a day, so you also must have 45 minutes on break. If you are doing other work for the rest of your shift, with no other breaks recorded, then your workingtime for each shift is 12 hours 15 minutes. More time on break or POA reduces the amount of working time you do.
Here’s a link to the VOSA Handbook, Drivers’ Hours and Tachograph Rules.
It has had the latest Tacho and WTD rules added to it, but they haven’t incorporated these rules into their diagrams and other examples yet.
on a 13 hour shift would you also have included a break to stop going over the 6 hours WTD - 6 hours on, break 30 mins then 6 hours on max making a total of 12.5 hours with 12 paid cos you would not have the 2nd 30 mins then go home!!■■
OR would it be something like - work 6 hours including 3 hours driving then 30 mins break (WTD 6 hour break rule) - followed by 4 hours work including 1.5 hours driving then 30 min break (4.5 drivers hours rule) which then leaves only 2 hours to complete the 13 so the max paid would be 12 hours and not 12.5■■? - is my logic flawed again
I think you’ve got a bit of confused logic in there Rog.
30 minutes on break if your shift is going to be 6 hours or longer.
But you can have a 15 minute breaks. So 15 minutes during the 6 hours and the other 15 before the end of your shift
45 minutes on break if your shift is going to be 9 hours or longer.
Again, 15 minutes break during the first 6 hours, 15 minutes break in less than 6 hours from your last break and 15 minutes before the end of your shift.
You could drive for 4 hours, take 15. Other work for another 4 hours, take 30. Drive back 4 hours, 15 minutes tidying things up, paperwork etc = 13 hour shift, all breaks required taken, everything neat and tidy to suit all the various legal requirements.

I think.
So you can do a total of 8 hours with only a 15 min break in the middle and then go home - I thought the WTD said that 30 mins had to be taken by or at the end of 6 hours■■?

No, as Simon said the wtd allows for a 30 minute break if you work more than 6 hours but no more than 9, this can be split in two parts of no less than 15 minutes, you must have a break during or at the end of 6 hours work but the exact length of that break isn’t given so it’s interpreted as a 15 minute break.

AH - Thanks - does that apply to most industries
That applies to people working to the WTD for mobile workers.
according to this an adult is entitled to a 20 minute break if they’re expected to work for more than a 6 hours stretch, that’s unless they come under other wtd regulations such as the wtd for mobile workers.
