Singled out for derogation?

i haven’t posted on here in a while. i’m sure a hot topic recentley has been the ‘awr’ and this ‘swedish cop out’ some of us agency workers have had to sign. i was on a contract last week chatting to a driver from the same agency as me. he was telling me he was dragged into the clients office a few weeks ago and told that he would be recieving a £600 rebate and would now be on full rate. i asked him about the ‘derogation’ that i signed last year, he said he knew nothing about that. my agency told me i needed to sign this ‘derogation’ or this client could offer me no more work, as they couldnt afford to pay us what their regular guys earn. this chaps been there just over 12 weeks, ive been there 2 years. obviousley the client does pay the full rate and this was just a lie from my agency. ether this, or the client can ask for just a proportion of employes from an agency to have this ‘derogation’ in place to help cut costs. although, this hardly seems fair. i’ve yet to tackle my agency about this. i just wanted to gather a bit of ‘intel’ before i did.

needless to say, im thinking of going elsewhere if the fob me off about this. does anyone know if its the norm now to get workers to sign this derogation before they sign up to an agency? seems pointless to leave one agency to get to another and have this ‘derogation’ pushed under my nose again.

Hi mate its a new one on me i have never heard of it before your post … :confused: sounds like some kind of cop-out to me but you dont have to leave an Agent to go with Another you can be with as many as you want Also the fact that you have been there 2 yrs means that you will have no trouble signing with other Agents they will be glad to have you on their books even if its only to pick your Brain and to find out what companies you have worked for from that Agent then they will try and get you in the same place on there books …All A gents are just salesmen …they sell you to the Cliant then sell work to you from the company :unamused: .

Untill someone is brave enough to take an agency to court the agenies will fiddle all staff, where i work there are 2 agencies 1 for drivers and 1 for office and warehouse staff,drivers are still on same money because firm does not pay more others got pay rise

thats actually what i was thinking of doing. phoning a couple of the agencies that i know supply this client also, and getting on their books. as long as i get equal pay obviously. theres nothing stopping me doing that is there? i’m not sure if the client might object though, as they will end up paying more for me. what do you think?

yes mac i agree. its early days yet. im sure we’ll see more court activity etc in the future…

Yea mate thats the thing to do like i say there is only 2 out of the 7 Agents i am with that I trust . and in a few weeks im gonna narrow the 7 down to 3 and then just see what happenes .
You will find that when you apply the new Agent will ask you to list where you have worked through that Agent then they use the exuse that they are just Phoning them for a reference and they will then try and get the company on there books :laughing: the only thing is that they have some rules about if they take you full time they must buy you from the Agent but I dont think that they all follow the rules :frowning: .

When I worked for R*iper Employment of Enfield, I got a lot of work at TK MAXX Hatfield and M&S Enfield, when i refused to go on to the JSA umbrealla scheme as it would actually cost me money being on the scheme I politely told by the agency that unless i do the Umbrella then I am not allowed to work for TK MAXX anymore … obviously they want the % of money that JSA took from me a miminum of 7.5% even if it was only 1 day a week.

I wanted to work for Premier Employment who had the contract direct however I was unable to do so for 8 weeks something in the contract stated that.

Agencies will use drivers as pawns to get work, one of the office bod’s asked me to get the name of the MD at Hatfield to take the work off of Premier, I refused , just to much underhand tactics from agencies … if I were to move back to UK I would prefer to work direct for a company even if it meant £1.50 hr less that way they would not try to mess you about with Umbrella schemes to avoid paying you holiday sick pay etc as an employee
