There is a possibilty i could become an even more obnoxious ■■■■ than i am already, and become a shunter can anyone tell me if a shunter who is in an enclosed yard with a vehicle not road registered and not using a tacho is covered by the R.T.D■■?, or would i have the option to do more than 48 hours a week? as in a NON mobile worker?.

the newly introduced (April 2005) RTR apply to drivers who fall under the EC driving regulations 3820/85 or under certain circumstances AETR rules. As an off-road shunter you do not come under the RTR because you do not come under 3820. Your work is covered by the older WTD Regs, which have a 48 hour week limit. However, you can opt out of this limit if you wish.
Be careful if you do any EC driving, for example a bit of agency work at weekends. If you drive more than 11 times in a 17 week reference period or 16 times in a 26 week period then you will come back into RTR and you cannot then opt out of the 48 hour average, 60 hour maximum weekly limits.
