Sharing drivers - legal or not?

I emailed VOSA to get their opinion on it (because I’m pretty confident that the person concerned won’t accept anyone else’s opinion).

What do you think they said?

VOSA:
I can find nothing wrong with what you propose.

I don’t want to say I told you so, but… Ach to hell with that I’m saying it anyway.

the company I work for has been doing this for years with no problems, and it’s a straight company

Pehraps I have this wrong but if you drive for 2hrs 15m then take a 2hr 15m break then doesn’t that expire one of your driving periods? because you have taken more than a 45m break?! :unamused: :unamused:

Not sure what you mean by ‘expire one of your driving periods’. It will reset the 4.5 hour driving time clock, meaning you could then drive for another 4.5 hours before needing another break, but that is all it would do. The driver would still have a further 6 hours 45 minutes driving available for a 9 hour driving day, or 7 hours 45 minutes for a 10.

Taking a 45 minute, or more, break before you have reached 4.5 hours driving does not mean you lose the ‘unused’ driving time from that period. I have heard drivers claim this is so in the past and wonder if that is what you meant by expire one of your driving periods?

Well, yes, and I agreed with you…

Hopefully I might be able to get him to admit he’s wrong, and then I can start going after the other things (like insisting that it’s perfectly legal to keep the mode switch on bed all day… :unamused: )
