it seems to come down to what is considered to be “reasonable”. A driver sleeping in the truck in a lay-by or outside a factory when it’s 200 miles away from its Operating Centre would be considered reasonable, a driver regularly taking his tractor unit home, parking in a residential area and sleeping in his house when the Operating Centre is only a few miles away wouldn’t be.

Agree it was a big mistake for the OP to write a lippy/stern letter, that is never going to end in anything other than tears before bedtime. Whether we like it or not, a Traffic Commissioner is considerably higher up the food chain than a hairy-arsed trucker and won’t take too kindly to being told to “go do one” when he/she has written to an operator reminding them of the terms of their Operating Licence.

OP should now prepare to “bend for Bubba and take it without lube” :wink:

well I’ve just been stung for 860 quid for moving with no card in, they took 4 months of my tacho’s after a dispute with an anonamouse (dunno how to spell that lol) neighbour about bringing my lorry home, they wanted to see where it had been kept during that period and unfortunately found i’d moved on 6 occasions with no card in - the total amount of missing k’s didn’t even add up to more than 50… a bit harsh in my opinion, but then I moved with no card in which is wrong in the eyes of the law. :frowning:

Who fined you? Vosa or the courts?
If vosa, Dispute it.
If it’s the courts, Appeal the conviction unless you pleaded guilty.

the courts fined me - I pleaded guilty, I was not out to hide anything from anyone - I didn’t think it was that serious, all I did was complete what I was doing and then go and park up, not, drive all over the country with the fuse out or a magnet attached etc…
as for taking the lorry home, I’ve been doing it for nearly 12 years on and off not on a regular basis, maybe once every 2 months or so to give it a good polish and a clean which is what I told vosa, the bloke who came out to my house said they didn’t really have a problem with it - but they have to look into complaints etc, in my case he was satisified I wasn’t making a habit of it the matter would be considered dealt with, he also said it was a shame they had found the other stuff because of a spineless neighbour, he did tell me though that you can use your truck for personal use as long as you put a card in to record your activities… and you need a very good reason to have done it. :slight_smile:

Going by other threads this boy has just passed his test and this is his first job. It’s no getting sent to vosa. It will be most likely be getting sent to the fta or some other company for its usual analysis.

Don’t leave printouts in the vehicle that explain any misgivings, always carry them with you, after 28 days hand it in to your transport office.

The 2 breaks really depend of the exact situation if you where close to 4.5hr drive or 6hr work. If the company does do analysis they will pull you up about the 6 hour rule.

My advice is if you are going to comprise your 4.5hr drive time never move off break, it’s just no worth the hassle writing out explanations.

Your infringement sheet will have all your details, vehicle details. Infringement codes which your tm should explain to you and beside it the possible roadside fine associated with that code.

If you continue to get infringements and
if your company is any good they should offer you remedial training but if they are a ■■■■ of a company they can technically give you a verbal warning.

I’ve no had an infringement in 3 years, before that on analogue i got 2/3 a month! Once you know the ins and outs and have a digital tacho you will be fine.

I thought if you moved the truck when on break then you’d have to start the break again? Not have say 15, move the truck to let someone out and the have another 15.

Depends how long the break is supposed to be for. If it’s a 30 then in the above example, yes, you would have to start your break again to have 30 minutes uninterrupted. If it was a 45, you could have 15, move, then have the other 30.

That’s correct, you can only move the vehicle during a break in the case of an emergency, and generally only with the authorisation of a competent authority such as police or fire service personal ec’t.

Other than an emergency you need to restart the break or have a split break of 15 minutes then 30 minutes.
