Can anyone tell me what the rules are for so called self employed through an agency.had a run in with mine last week and after weeks of being messed about just said I wasn’t doing it, so got my shift the next day cancelled and all my shifts for this week taken off me.what come back do I have if any, and who regulates the agency/self-employed ? . or is just a case of find another agency, and let them win again.

When you state “you where not doing it” what do you mean? Your not doing self employment or not doing the shift?
That’s the reason why agencies want you as self-employed, you have absolutely no rights and no comeback. Even the couple of contracts I’ve seen offered say things like ‘zero hours’ which essentially mean ‘we guarantee nothing’.
The agency system in this country needs a total overhaul, but unfortunately there are too many people chasing too little work and the big agency bosses are, like the banks, in charge of the government so it isn’t going to change in the near future.
When I say I wasn’t doing it I meant I wasn’t doing the shift, I had agreed a time and place and the last minute change of plans didn’t suit my plans so I said no to it.then the big argument as how your not flexible blah blah .
When you turn a shift down, or changed your mind about a shift you agreed to do, even if the start time has been changed +/- by a few hours then they’ll stop calling you, & move onto the next person who’s willing to take the shift & be flexible.
basically the parasitic pond -dross agency,has decided to teach those who wont conform, a lesson…this is due to theres always someone else to fill the spaces

s but I very much doubt youll get any agency to agree to them, I once had some jumped up bint storm off in a strop when I passed her a copy of my T
s & Cs and its highly unlikely you
ll get any agency to actually sign your terms. They seem to think that they can dictate the conditions one directional, rather than the other way around. After all there’s plenty of mugs wholl do the job without requiring their own T

To get around the dumb bint syndrome, I bury in the small print the phrase “by being given a copy of my companies terms and conditions you accept these terms even if you do not sign it” so even if they file it in B1N I have a copy of the term on file

OK, that’s what I thought might be the case.
Is it true that alot of agencies will not entertain a Self Employed/Sole Trader as there is some sort of Tax liability ?
Is Limited Company the best way to go ?
I’m asking these questions as I’ve just lost my job and am looking at my options. (can’t seem to get a straight answer from the agencies I’ve spoken to).
There are probably many reasons why agys won’t entertain sole traders & most of the answers will be very boring & have been covered before, so I’ll refer you to the search button up in the corner.
Many choose the Ltd route as it limits their liabilities & losses in the event of it going ■■■■ up.
Ltd Co isn’t always the best route, many are pushed into it by agys without understanding the consequences or the work involved. So before you go down this route you should ask yourself do you want the extra responsibility of the burden of running your own firm, as its realistically a long term thing. Something you should only consider if the lifestyle of being an agy driver long term is for you.
PAYE is obviously the the best but it comes with the additional liabilities of NI & income tax that takes a massive chunk of your earnings

Yes I tried the ‘Search’ button but there was no definitive answer as to what is the best route to go down and as you’ve just explained, it all depends on your own personal situation. Alot of drivers seem happy with the umbrella company way, which to me is just another expense. I’m the type of person who wants to do as much as possible myself e.g sorting expenses, finding the work (don’t really want to use an agency to find the work, though this may be hard ?). Basically a tight arse who doesn’t want to give other people a cut of my earnings.
One agency would only give me a maximum of 1 week PAYE then no work unless I went Limited !!

Id have took the 1 weeks work then walked away, as no doubt a few weeks down the line they
d call you to cover another job & repeated the 1 week PAYE

Tell them to f off if the they rang again this was done to me did the work 2 days later begging me to work again there loss. I do not like being blackmailed into doing something I do not want to do.
They need you more than you need them. When they are scratching around looking for a driver to fill an assignment they will come on to you no matter how much shouting at each other went on.
Do you send them a time-sheet or do you raise an invoice to them? You can put your terms and conditions on the bottom or the back of your invoices. This does not mean that they are enforceable but puts you in a better position if you have to take them to the Small Claims Court
I can’t see many agencies at all signing up to any driver’s T&C’s.
However, as long as no agency penalises bods for refusing this shift because it’s crap, that one because it’s too far, and the other one because they’ve attempted to drop a stupid o’clock start time in your lap when you’re about to go to bed - we’ll all be alright in the end.
Agencies need workers to get the job done. Getting the job done can be done without an agency. Agencies with no drivers don’t make any money.
I’d say the balance of power is on the side of the driver - they just need to realise their own worth to capitalise on this.

Self employed? Zero protection. You’re on your own with absolutely no rights and protections under employment law. They don’t even have to pay you if they don’t want to.
What come back you have is dependant on what terms of business you got your agency to sign. You do have terms of business don’t you?

ll be on the phone before the weeks out.they are trying to scare you with the prospesct of getting no work…just so youll do what ever they say. don
t fall for it.
next time they phone,tell em your unavailable(even if you are)…don`t let em think you are relying on them alone…and do not let them intimidate you.
work should start hotting up now…there is no way they will want to lose a decent driver from their books.

Why do you say that work should start hotting up ? we are being phoned all day every day by agencies looking to place drivers at the moment.
