Parked up for my 45, put tacho on break, dozed for a bit, set off, driving time hasn’t reset. Parked up again to check and it looks like I left it on “other work” by mistake. ■■■■■■■■. Now having another 45 being rocked to sleep in a layby. Bloody hate laybys.

Unless you wanted that 2nd ‘shaky’ sleep sir, you do know you need’nt have had it??
Just do a print out & write phrases on the back of printout including words such as ‘driver’s error’ & ‘mode switch left on other work between ■■:xxhrs & ■■:xxhrs instead of rest’. Job done, no infringement exists, common sense prevails & you merrily crack on driver. Do not be a slave to that little box!
Unless you are paid hourly & were knackered, & have no real deadlines to meet…in which case, I’d say kip at every opportunity!

Infringement does exist it’s incorrect mode selection and depending on the company they will point it out. Some places allow 2 or 3 then you get the letter

Don’t quite understand this as I was of the impression that ANY tacho, analogue or digi, should default to driving mode irrespective of what position the mode switch is in!

Although originally they were supposed to default to other work, I seem to remember that being changed so they could be made to default to rest, but anyway what the OP is saying is that after he took his break the driving time didn’t re-set meaning he hadn’t had the tacho on break.
Personally if I could I’d bang in a 45 just clears everything and saves any questions later, but if I couldn’t then it would be a printout with a explanation on it, only ever been stopped by VOSA once with a card that I’d written an explanation on and all I got was a wry smile and a “yea I’ll give you the benefit of the doubt” Although I can’t say that the spotty youth who uses the software to analyses your tacho, but has no real world experience will see it the same way.
