I doubt it, you must do a printout immediately upon stopping in a suitable place & explain why you went over. They should take this if you don’t have more than a handful on there. That is my understanding, don’t take it as red as they are self funding now so, reason may have gone out the window in favour of the taking your green. I don’t worry about it anymore. I love the road but I’m old enough now to start getting a bit peed off with all the chronic driving I see everyday, more & more people simply have a death wish in my opinion so I wouldn’t mind if they took my licence, get someone else to deliver all that kit. If that happens I’m just going to emigrate somewhere less ■■■■.

Yup. It’s your licence at the end of the day, so don’t risk losing it for anyone.
State the facts in a cool, calm manner and leave it at that. They can’t fire you for driving legally.
Don’t risk it anymore, park up as best you can in the time you have.

I was on the pumps at Tibshelf last week struggling with a bloody petrol cap that wouldn’t come off and a guy in a rigid pulled up next to me and said he had 10 minutes drive left but had to get to Nottingham for a delivery. His boss had said that if he did a printout and wrote on the back he’d be OK. He asked me what I thought so I told him that no it wasn’t OK and he needs to park up. As we talked further he said that it was regular on the job. I just said I’d not work for a company who operated like that.

There is no legal requirement to take a printout at the end of your shift, unless you are running without a card due to loss or damage and are awaiting a replacement card. Some companies require you to take one, but that is their requirement, not a legal one. Any information that DVSA etc require will be available via the digi card itself or the tacho head.
I have done three printouts in 5 years, and they were only for running over time due to RTA’s. On each occasion I signed the back with details of where and why each infringement occured.

Think about it. They have a digicard that keeps at least a 28 day record of activity. Why would they need a printout if its on the card?

From a legal point of view the card reader is to aid DVSA,if they don’t have one or it’s not working it’s still YOUR responsibility to produce your records that’s why you are supposed to carry spare tacho rolls.
Reading the link provided, I’d personally say you’ve complied if you allow access to your card. It’s written as an ‘or’ statement. Provide records sheets, data card or printouts.
If DVSA haven’t facility to check card that’s their issue, as a driver I’ve complied by providing my card.
Not that they would ever not have facility to inspect it! So moot point really.
Sometime we read way way too much into regulations and over complicate what should be simple.
Unfortunately that is and always will be a problem when different people read a regulation and have their own interpretation on what it means to be compliant

I can only speak for me,I don’t give them a second thought,my only thought is I want to be at home for the w/end and I’m going too be.
Most w/ends there’s plenty of trucks parked up,not used ,so I’ve no doubt they wouldn’t give a second thought to a truck / driver spending a night/nights in a layby,in actual fact I know they wouldn’t,all they care about is the load got delivered and on time,after that ,well if you can get back ok,if not rough it .
