i don’t think the specific question - can you cross a solid white line (which is nearest to you or they both are) to access a lay-by on the opposite side of the carriageway? is a basic part of the highway code. there quite possibly isn’t a definitive answer until a judge decides if a lay-by is covered in the following, if they haven’t already?
(6) Nothing in paragraph (2)(b ) shall be taken to prohibit a vehicle from being driven across, or so as to straddle, the continuous line referred to in that paragraph, if it is safe to do so and if necessary to do so - (a) to enable the vehicle to enter, from the side of the road on which it is proceeding, land or premises adjacent to the length of road on which the line is placed, or another road joining that road;

Maybe or maybe not, but he’s got a great big problem getting back out onto the carriageway. Not sure if thats in the Highway code or not, but my own commonsense tells me that. Also appears to ring true with a lot of these other drivers here who, like me, don’t know what they’re doing !!!
Just imagine a cyclist coming alongside that lorry infront of him, he could easily pull out on it as its approaching and not see it, maybe even wiping out a whole family !!

I quite agree Mike.It was a totally stupid to park in a layby on the opposite side of the road.Not so bad getting out if the other truck had not come along but still not ideal.
The point I was trying to make is that actually crossing the lines to enter the layby is quite legal but some seem to think it is not for some reason.

Well as pointed out by Stevieboy just above, its somewhat a grey area. Its not a premises, is the turn neccesary ? I’ve no idea. What i do know is they usually paint them lines when there is a limited visibility, i.e a bend, a summit or something so without really seeing the whole layout its hard to be definitive. I’d agree with the consensus, whether their intimate knowledge of the highway code is spot on is neither here nor there in this case. IMO. The actual cause of the OP’s difficulty is his own making, everyone has picked up on this fact. Even if everyone is wrong on the highway code, it still doesn’t change anything, and infact proves the case that many HGV drivers are aware of dangers existing even if a rule book doesn’t mention the scenario.

It has been. You COULD (highly unlikely, but you never know if it’s spotted by a bored copper)be charged with “TS20 Failing to comply with double white lines”, which is endorseable, 3 points £100 fine.
Can’t believe how long this topic has got. It’s not exactly crime of the century… we’ve all done it, you’d be one unlucky ■■■■■■■ to get done for it tho (my mate is one unlucky ■■■■■■■ ), but trying to argue that it’s perfectly fine and legal is just, flawed.

By luck he was legal, but didn’t know that at the time! He went to court, the copper, possibly after reading up and realising his mistake, didn’t.

Yeah! He had about 20 or 40kgs to spare. But the copper didn’t have a clue and was a right arse apparently.
Edit - well it was over 750kgs but the combination was under 3500kgs

if you have a read a bit further up, you’ll see i entered this part of the debate questioning albion’s claim that’s legal. i said there quite possibly isn’t a definitive answer until a judge decides, if they haven’t already? you said it has been and said your mates been done. but when questioned, he took a fpn and you’ve no knowledge of a judge / court ruling.
at no point have i said i think it’s legal, i think it’s a grey area that would need testing in the courts, but if i were a betting man, i’d place my money on it being illegal. legal or not, i won’t be parking like that, because i think it creates unnecessary hassle / problems. so i won’t be getting the choice of fpn or court, but if i did i’d take the fpn
