Rest Period While At Home

Can a transport manger call me while im on rest period at home to start my shift early?

My contract start time is 1600 but they have the rite to change this by 2 hours as long as they tell me at the end of shift for the next day.

So if they just call me out the blue at 1300 and ask if i can come in for say 1500 can i say no to them?

If they was a good firm and played fare i wouldent mind but they dont!!

The drivers hours have nothing to do with this, its all down to your contract of employment. He can legally ask you to start at anytime…as long as you’ve have the rest period required by law. Its up to you if you decide to accept or decline

Check your contract of employment and find out if there is anything relating to his, you might find they used a phrase change of working pattern… but then any adjustments to your normal schedule, you must be give sufficient notice…

If your contract says they must tell you the start time at the end of the previous shift, or if that’s the usual practice and there’s nothing in your contract about it, politely tell them they’re being unreasonable and should give you more warning of a change to your start time.

On the other hand if it’s just an occasional thing that happens when their circumstances change, such another driver phoning in sick or whatever, I’d try to accommodate them as long as it didn’t inconvenience my life too much.

Just do what we used to do on the Railway "you’ve disturbed my rest period so it re starts now see you in ten hours " soon put a stop to them phoning at stupid times

I would let it go this time and turn up for when they ask. In future however, if you are not happy with the idea, why not just don’t answer the phone? Caller id is your friend.

+2 They can call whenever they like its your choice to answer or not. Me I would probably answer ou of curiosity or return the call when in the mood. Its your free time to dispose of as you wish after all.

Mike, you are talking absolute ■■■■■■■■■■■■■■■■ had one of the more sensible answers: if the firm is ok normally why not do them a favour its only changed by a couple of hours, and in transport the unnexpected can happen.

A simple response would be “sorry boss, I’ve got a doctors/dentist appointment just before my expected start time” that I booked weeks ago on the basis I wasn’t expecting to be called in early
