Hello I’m looking for any advice or guidelines on the rules for rescuing an out of hours driver. Thanks in advance

The simple answer is, it depends what type of hours is the driver out of?
Just fetch him and worry about the hours tomorrow
Driving hours? Duty hours?
You’ll need a driver for the truck, and a driver for the van. Unless the rescued drover can take the van home, and keep it till his next shift starts. Then he can drive the van, and you only need to send one driver out.
The driver will be out of his 15 working hours. How often can this be done? A one off or can it be done all the time? If the driver is sent out knowing he can’t get back due to volume of work can he still be rescued? Thanks again

no, only as a one off, and only if you can show that the driver was unforseen delayed. And also near home. You can’t sent out a driver and van two hours up the road.

Not off hand, but Arla used to do it when I worked there, and they run straight.

The CPC holder for the Operators License of their company. This is mandatory stuff they have to know. Failing that tell them to phone VOSA.

As far as I understand the regs a driver isn’t considered to be on rest period even if they a passenger in a vehicle collecting them away from base after completing a 15 hour day or 13 hour if they have no reduced rest periods left.
And this was clarified in a test case involving a coach company who took drivers to and from their coaches parked in various parts of the country to swap with the other drivers.
But if it was a one off due to unforeseen circumstances, such as sitting for hours in a road closure, I doubt the DVSA wouldn’t be to concerned. But if it happened regularly then then DVSA might ask questions about the company’s planning.

Travelling time
Where a vehicle coming within the scope of the EU rules is neither at the driver’s home nor at the employer’s operational centre where the driver is normally based, but is at a separate location, time spent travelling to or from that location to take charge of the vehicle may not be counted as a rest or break, unless the driver is in a ferry or train and has access to a bunk or couchette.
You will be fine when we leave the EU and go back to logbooks
