Regular weekly rest away from base - ok in unit?

Article 8.8 only refurs to daily rest periods and reduced weekly rest periods away from base - but what about a regular weekly rest period - can you take this in your cab ?

According to the letter of the law, you can’t, although nobody seems to enforce this.

You could pitch a tent next to your cab and take a 45 hour rest in that. :wink:

i’m really not sure on this, but thought/think, you can maybe 2 weekly rests in the truck when away, but come the 3rd, it has to be taken away from the vehicle, and if any of the previous two were reduced weekly rests, this time had to be added aswell.
i’m probably wrong.

A regular 45 weekly rest cannot be taken in a vehicle when away from base. Many do and in the UK I don’t think this is enforced but I have been told many tales of it being enforced abroad.

I think there’s an assumption that on a regular weekly rest you will go home. It says no where that you have to !!!

Of course you can.

You can have as many reduced weekly rests in a row as you like as long as you make sure you have a full weekly rest in every second week.

8. Where a driver chooses to do this, daily rest periods and
reduced weekly rest periods away from base may be taken in a
vehicle, as long as it has suitable sleeping facilities for each
driver and the vehicle is stationary.

As you can see above the regulations allow you to take daily and reduced weekly rest periods away from base in a vehicle. The very fact that it specifices “reduced weekly rests” instead of simply saying “weekly rests” tells us that regular weekly rests away from base in a vehicle are not technically legal.

The daft thing about this is that in the middle of winter when it’s minus-something outside, you’re legally allowed to take a regular weekly rest in a tent pitched next to your truck but if you spend it in the nice warm comfy truck you’re breaking the law.

Of course nobody is ever going to get done for it in the real world.
