Reduced and compensated breaks

Simple enough question.
Start a week on a Saturday,15.00 hrs.(After last working on the previous Tuesday at 06.00,so cards 100%).
Saturday,Sunday,Monday and Tuesday are working shifts(all 9-10 hrs per day),still 100%.
Commence reduced weekly rest at 19.30 on the Tuesday until Wednesday 07.30,(therefore 36 hours taken as a reduced rest,9 hrs short of a “proper” weekly break of 45 hours).
Question:When it comes to compensating my weekly rest,by the end of the third week,do I just stick on the 9 hours,or 21(as the reduced break of 24 has been taken,and the 24 is all thats recorded.) Cant find any definitive wording on it.
P.S. asked a question here a few months ago,regarding shunter duties in an unregulated tugmaster,MIXED with on road driving.Told to fill in cards,manually, for ALL days worked,plus of course my tacho charts.Stopped by VOSA—VERY IMPRESSED :smiley:

The MINIMUM is 24 hours but you had 36 so only 9 to pay back

You just pay back the actual reduction which in this case is 9 hours :wink:

Compensation can be added to any rest period of at least 9 hours and should be paid back by the end of the third week following the week in which the reduced weekly rest was taken.

If you’re saying the VOSA person was impressed by your record keeping it’s good to know they appreciate it when people try to do things right, and I think you’ll find that would have scored a positive mark for your employer on the green light system :wink:

Thanks lads,the clarification on the reduced hours is great.Wasn`t aware it could be stuck onto ANY 9hr break though.

If you take 36 hours weekly rest it won’t be recorded as 24 hours, the gap in your records will be 36 hours.

Here you are, page 18, halfway down where it says.

If a reduction is taken, it must be compensated for by an equivalent period of rest taken in one block before the end of the third week following the week in question.

The word equivalent is the definitive word you were looking for, the compensation is equivalent to the reduction.
