Had to move slightly during a 3hr load. Wasn’t more than 20 seconds. Stuck it back on break and didn’t lose the breaktime accumulated.
All good for a 15?

As long as the tachograph recorded 3 straight unbroken hours of rest I can’t see a problem.

If stopped in the same vehicle and they check, the movement will automatically be flagged up, therefore if you are using this a a split rest it won’t count.
So you’re risking a insufficient daily rest fine.
A few months ago you’d have got away with it, but they now have new software that picks it up
Hmm 2 different answers. Which one is right

3 or 4 months ago the 1st one!
Now the 2nd one!
Unlikely to get caught, but if you do it’s the chance you take
They´re both right, aren´t they?
The tacho did indeed bank 3 hrs continuous.
Devils advocate and i do use this as a split, ignoring mr vosa, will this flag as an infringement back at my works come download time?

There was a thread here last week where somebody moved a lorry briefly during his 9 off. In a roadside check the DVSA officer was able to spot the movement even though the driver didn’t have his card in.
When you moved for 20 seconds it would have flicked onto other work, and you put it back onto rest with rest continuing unbroken. But, the movement would have been recorded. It just won’t flag up as an infringement, but can be seen on a roadside check.
Go and see the thread for the punishment the driver received. It might make you think twice before turning your shift into a 15.
You’ll be fine, keep it lit and ignore the scary stories.
Even if you were likely to get done, how likely are you to get a tug?

I think you’re probably referring to this thread but it was a very different.

Im not sure that other thread can compare. His movement was minutes with card out the naughty boy. Mine was seconds, card in and the tacho reported 3 hrs continuous.

It’s a totally different scenario, like I said, the tacho has recorded the 3 hours continuous break / rest, you’ll have no infringement back from the analysis company, but if stopped in the same truck and they check, then they’ll see you haven’t had a 3 hour rest period, so not qualified for a split rest, so chances are you’ll get whatever the consequences are depending on what you’ve done, it’s the chance you take, unlikely to get caught, but don’t ■■■■■ if you do!
