Fuse it isn’t work, it is either break or rest depending on the time it took. He could have gone fishing or swimming or sat talking about lorries to a salesman, but it isn’t work
starfighter:
That’s my point, if they told him a time it’s kosher. If they didnt then it should be break. However who would know whether he was told anything or not.
That was my point too, no-one has to tell you how long it is going to take if you have prior knowledge or even an inkling.
If you have a leaking radiator. I would envisage a garage is going to take around 3 hours to swap it over, if they have one in stock.
Not strictly true,in reallity he would have gone in volvo with an empty bait box in all probability he would not have his fishing gear or his trunks,he couldnot have gone for a pint or have a session with his missus, no sorry wheel nut hes at work, but for the purpose of the regs he can book it as poa.

Yes but I can’t do any of those things while I’m sat for 45 minutes in some ■■■■ soaked layby either but it still can legally count as break.
I would have booked it as break and then, as has already been said, it could count towards a split daily rest which could make life a lot easier as we get towards the end of the week.
Paul
It’s not work just because he’s at work. I presume you’re at work when you take your break, unless you’re driving a local skip motor and go home for lunch
Well there is nothing to stop him booking it as work but he’s losing the chance to get his working hours down. It could go down as work or poa, whichever works out most advantageous.

Ok say he’s drove an hour after logging on and his 15 min vehicle daily checks then left it on other work and the fitter fixes it for 4 hrs and 46 mins he would be over his 6hr rule! Book it as you see fit! Three hour split daily rest or POA! POA is a farce but until they rid it, it shall be abused to keep your hours down!
come to stobarts and do 84hrs a week pal
easy sat on your article doing nowt all week and getting paid for it!
and if you wish to dispose of your time freely get some DOGGING done in uniform! Meeoowww! Ruff ruff I meant
You wouldnt think it would be this hard .
My answer to the question: break.
redbob:
I suppose it depends what you put it on before ejecting it
Hopefully she puts on a tin hat before it ejects
Put the card back in after about 4 hours, done a printout and wrote on the back that lorry was in garage and I was on a break. I was sat in Volvo in wallsall watching Jeremy Kyle and drinking tea, beats working
Break yes, but I wouldn’t book it as part of a split rest because for that you have to be able to use the time as you see fit.
If VOSA pulled you and looked into it, they would see that the vehicle was undergoing maintenance (maybe cab tilted?) so you would possibly be in a bit of difficulty unless you could prove that you knew it would be more than 3 hours and you didn’t fancy a sleep in the bunk (sleeping facilities must be available as part of rest). Best to leave it as break and not use it as a split break, unless you’ve used up all your reduced rest times this week and want to take the risk to get home on Friday.
schrodingers cat:
(sleeping facilities must be available as part of rest)
Not true, only if you are taking the rest in the cab or when using the interrupted rest option while using a ferry or train. For a normal rest there is no mention of sleeping facilities being available. Provided he didn’t have to stay with the vehicle and could have gone off and done something else then it could be used as part of a split rest.

Printout mot necessary, the manual entry to cover the time the card was out of the VU is sufficient.
Jesus wept.
It’s a wonder any of manage to get up in the morning without falling over.
It really isn’t as complicated as people seem to LOVE making it seem.
The answer to all your questions is all follows: What Coffee says is correct, the rest is overcomplicated wibble. As any fool know.
POA is a nonsense, don’t use it (unless of course you work for a cowboy operator who doesn’t pay breaks but pays POA). It doesn’t even exist in the EU drivers hours rules. Only the WTD. Most importantly, for clarity, if it qualifies for POA it qualifies for break.
There are three modes in a drivers life, one is automatic. The other two are rest, and other work.
Oh, and maybe something about a ferry mode, load of black magic if you ask me, I don’t venture off the island.
Of course, this only counts if its Wednesday, or Sunday, not a leap year, you haven’t eaten yet, have less than 7 pounds in native currency, are not carrying a flashlight, or a warning triangle, have a bump cap, but not a hard hat, have not walked clockwise around your lorry more than three times in the last 24 hours, and half wound the landing legs all the way home, have no chalk, and only one pillow. Oh, and if it’s July, doesn’t count either.
Of course, if you’ve got a box of fishing tackle, but not a fishing chair, then this over writes all the above.
Don’t forget your printout… dated, signed and with ‘■■■■’ written clearly across the top.
Clear? Good.
