Quick question about car insurance

If I let someone drive my car and they are not insured on it, who is responsible for any third party damage if she crashes it? Me the owner or her the driver?

Assuming they told you they were insured and you were not a party to an illegal act then the driver is fully responsible

I’m not sure but I imagine the driver would be responsible, however I would think that if the third party was unable to get compensation from the driver they could probably sue you for the cost of the damages, especially if it could be shown that you knowingly allowed an uninsured driver use your vehicle.

Either way you would be committing an offence if you knowingly let an uninsured driver use your vehicle.

Having said that I’m not sure how much effort you’re legally required put into ensuring that the person using your vehicle is insured.

Your insurance will cover any third party damage, even in the event that the driver is uninsured. The company can recover these costs from said driver or the policy holder depending on the circumstances.

Lending your car to a friend is a minefield when it comes to insurance, more & more policies now don’t give the “driving other cars” permission… even fully comp!

If you really want to lend then you cover your ■■■…

a) Ask to see their insurance policy & make sure yourself, it will say either way.
b) Make lending the car conditional on them having insurance to drive it [Newbury -v- Davis [1974] RTR 367]

Simply asking if they are insured isn’t, I believe, sufficient & will lead to loads of grief.
