Question on Driving hours

Hi,
If the driver started work at 6am drove to 9am then have a break 3hrs from 9am to 12am finished work on 21.00 and had 9hrs break. So started work next day at 6am. Does previous day count as 15hrs shift or 13hrs? Thanks

Split daily rest so it is a 13 hour day if you want to call it that.

It’s a split daily rest period which counts as a regular daily rest period not a reduced daily rest period, so if the driver had 3 reduced daily rest periods available before having a split daily rest period he still has 3 reduced daily rest periods available after the split daily rest perod.

It’s still a 15 hour shift but the driver had a regular daily rest period.

edit: As much as I dislike the term because I think it’s confusing it counts as what you’re calling a 13.

Forget shift lengths. The regs don’t directly limit what length of shift you can work. They stipulate minimums on daily rest which in turn puts a limit on the maximum length a shift can be. A regular rest is 11 and a reduced 9. You could work 8 hours, take 9 off a this will count as a reduced daily rest. But you haven’t worked 15 hours, far from it.
