Question about Hours. Gurus please

You were not double manning, but you did not do too much work, you simply neglected to record a break for the RTD. I do not believe there is any need to record a RTD break on a tachograph, you can record it on a timesheet or in a diary, the WTD records must be kept for 24 months, tachograph records only need to be kept for 12 months.

To be fair I would have kept the card in my wallet and then made a manual entry once I got my truck back. The only choice you have on a moving truck is POA, you cannot record other work or a break, if you do other work, you must record that manually either on a paper chart or a printout.

Perhaps I’m missing something here. The OP has done 3 hours and 30 minutes work with some 3 hours of POA in between the 5 minutes of work following 3 hours of driving and him doing 5 minutes work before finishing his shift.

I really don’t see what the issue is…other than analysis software that isn’t worth the money.

A break is required under EU drivers hours rules if the driving time reaches 4 and a half hours.

A break is required under RT(WT)R if the working time gets to 6 hours.

Neither of the limits above have been reached, therefore no break is required.

POA is not work. The double manning thing and digital tachos resetting driving time after 45 minutes of Availability have nothing to do with this.

The OP did the right thing by putting his card in slot 2 to record the journey back. He needs to record all of the time spent on duty, so using the Tacho seems to be the most logical way of doing that. He could have left the card out and done a manual entry when he next used his card, but why make life complicated?
