Proper Procedure for Tachograph Seizure

What is the proper procedure for the police to seize tachographs?

Do they need to issue a receipt?

What if they did not?

Do they need to interview the driver under caution?

Is anything that was said without being cautioned admissable in court?

If a search of the cab took place should I have received a record of that search?

They need to caution you if they are charging you, anything said not under caution shouldnt be used (i think) but they will use it anyways and claim you said it under caution when it comes down to it whos a judge gonna believe two policemen or a single truck driver. Heard this from the horses mouth.

If i was going to be getting into the situation where i was gonna get charged with something i’d either keep my mouth zipped (since heard it said before a lot of drivers talk themselves into serious trouble) or get someone like your boss on the phone on speakerphone record the conversation.

Heard of a few people ending up in court and the transcript of what they supposedly admited to and said under caution was very different from what they actually said.

PM Shrek,
