It is also an offence to phone someone when you know it is illegal for them to answer although I am not sure if it a specific offence or if it comes under a general category like incitement

Remember that answering even a hands free phone is distracting your attention from driving . Should you be involved in a serious accident it will be an easy matter for the prosecution to prove that you were on the phone at the time. You cannot concentrate on two things at once, particularly if the tone of the conversation from the other end is becoming menacing. So if this starts happening or has happened in the past, don’t answer the phone, pull into the next service area and ring them back.Explain ever-so- politely that you needed to concentrate on the road, which is why at the first available opportunity you have now stopped to find out what they want. And if you feel like it remind them that this stop has delayed your return. If there is no phone supplied by the company just switch yours off.

If it boils down to the Tm is a moron and doesn’t plan well your boss will see through the BS… If its an issue where you loading and unloading then its down to the TM to deal with…end of the day its his job, what does he think he’s being paid for…If the issues continue or they try and hold disciplinary action, then make sure you have a witness. And use you diary as your evidence…
By all means join a Union, good thing to have in place when things go wrong or you end up having issues such as this I would consider either Unite or URTU the later is dedicated to serving the interests of HGV, LGV, lorry, truck drivers and warehouse staff…
Just see how the next week goes… Oh be sure to drop it out, once you’ve joined a Union then certain ppl would think twice about intimidating staff with ultimatums

They didn’t give you a cit was ntract? They are d to provide a written contract within 3 months of taking you on. Add o the list of concerns to put forward to your legal advisorThey gave me a contract which I didn’t agree to some of the contents & the boss said well have to go through it , only this never happened, so not signed by me.
Your continuing to work is deemed to be acceptance of the contract.
As far as I am concerned I did not agree with the contract & didn’t sign it , It was agreed that we would discuss it, although that never happened. So that is something I shall be looking into.

However I believe there is some exceptions to this, which are dismissal or non employment due to racism or sexism. Assuming your are the only female there, it seems to me you are being treated different to the rest, and are the victim of bullying.
The easiest solution is just to jack it in, and find another job, but in the mean time as said by others have a chat with acas, and citizens advice ( both free) and an employment lawyer if you can find one. Most importantly as well keep on writing your diary. Very useful evidence for the future.
Sad thing you find TMs this all over the industry and so long as you know you not sandbagging it, then you have to develop a thick skin.

Implied acceptance or not, they are failing in their legal obligations. As an outsider, how do I know that this driver has ever seen a contract if there is no proof of one? I never received one from Exel but I used that to my advantage by refusing to wear their uniform because it was green and I supported rangers

Don’t get me wrong. I Am not saying you should walk from your job. I’m just saying if another job presents it self, then it may save a lot of aggro and stress to take it, rather than trying to prove you have a case with the mob you with now.
Of course on the other hand. For justice’s sake alone it would be nice if you could sort this out. Like I said seeking advice from the organisations mentioned earlier will help you with letting you know what to expect and your chances of winning a potential case.

but hey ho no matter how you look at it your being shafted left right and centre. for me I would be on the phone every 20 mins sat waiting to the traffic office (they will get ■■■■■■ off quite quick), or just work to rule and be as big a pain in the arse as you can be.
i cant see what else you can do? if they wont listen / are being dicks its not likely to change anytime quick. so its either just say yeah yeah yeah or move on as far as i can see. yes you can go solicitors legal etc but what if anything will change? transport is fickle and its easy to move from one to the other so move on and put it down to experience.
its a shame but i cant see you winning anything either way and yes its wrong but unless you get some backing from others at your place, i cant see anyone coming out any better.

Everybody who has posted on this thread have done so with their veiws and integrity. And very much appreciated by myself who is in need of sound advice. I thank everyone for their postings, they have been very helpful.
I shall be looking elsewhere for employment, and will be using the advice given by some of posters on this thread.
You are right they are being idiots, and won’t listen, and the atmosphere is very frosty, I also seems that they are setting one driver off against another, & causing a rift.
Personally I’m offering advice because I found myself in similar circumstances, after working in transport for a short period of time. It was a bit of an eye opener after spending my life doing lab work, at differing companies. Wherever I worked though I was always treated with respect.More importantly if there ever was some kind of employment problem, there was set rules and procedures to follow.
So when I found myself on the receiving of a tirade of baseless accusations from some pompuous twerp whilst still fairly green in truck driving, it’s very difficult to know what to say or do. Even worse of course when you have bills to pay. That’s what a lot of these jerks rely on. You’ll bow down and accept their bs because they think you have no choice.
Well in my case I managed to get compensation after my first job became untenable shall we say, but only after I got some good advice from my dad (who used to work as an HR manager), a ACAS/Emplyoment tribunal, but also from people On here.
It’s good to be able to ask folks who are in the same sort of job if your doing something wrong or if your TM really is behaving like a prize ■■■.
Unfortunately over the last 8 years or so I come across a few office bullies, and developing a thick skin, but also having a stratagy to deal with them is very useful.
my point was, I can imagine a bloke being told to man up etc. not given some of the advice which has been posted.
as I said either way its a shame that in 2015 you cant just go to work and do your job without some ■■■■ making it a misery. best of luck in finding a better employer.

Until the companies sort their act out in terms of pay and conditions (including how they treat their staff) it won’t get sorted.
Giving the companies grants to pay to train drivers is just another way of trapping new drivers into indentured slavery. They already have form for this with their policy on the DCPC.
What WOULD help is to subsidise new drivers by making the training accessible through an Individual Learning Account (ILA) scheme, like we have in Scotland.
half the trouble is people who plan have no balls and therefore by being yes men will instantly screw the job up by trying to cut things to fine, which in turn leads to them being given grief and as a driver at the bottom of the ladder its all of a sudden your fault.
which is why for me there is a whole lot more than money to consider in a job.
