The way I heard it yesterday was that was the initial plea pertaining to the ECHR and that was the state of play at the time that was broadcast.
Probably the lawyer failed at that one and started clutching at straws of legality and appeal.
Whatever…it does not look like any body is going back anytime soon.
The cynic in me says that with Starmer dedicating most of his working life into human rights law he must have been well aware of this possubility or loophole from day 1.

Read his case was turned down and he has been returned to France so hopefully the courts getting a bit tougher
